En muchas ocasiones se trata de bienes o servicios que no estaban siendo completamente utilizados y gracias a la economía colaborativa una persona puede beneficiarse de ese bien o servicio, mientras la propietaria obtiene una ganancia. Por ello, al consumo de bienes y servicios de forma colaborativa entre particulares se le conoce como consumo colaborativo. Anteriormente, el consumo colaborativo se limitaba a nuestro ámbito geográfico y círculo más cercano. Sin embargo, gracias a Internet, es posible conectar con personas de todo el mundo con intereses comunes. La digitalización de la sociedad y la crisis económica, favoreció el desarrollo de nuevos modelos de negocio y nuevas formas de consumo.

Jobs are crucial for individual well-being. They provide a livelihood and, equally important, a sense of dignity. They are also crucial for collective well-being and economic growth. Over the past decade, technology has fundamentally shifted traditional work patterns, creating new ways in which work is contracted, performed, managed, scheduled, and remunerated. New business models, digital platform firms, are allowing the effects of technology to reach more people more quickly, bringing economic opportunity to millions of people who do not live in industrialized countries or even industrial areas, simply with access to broadband and a digital device (World Bank 2019). Digital labor platforms play a role in the process of structural transformation especially by triggering organizational and occupational transformations, for example, by enhancing labor productivity and formalization in service sectors (Nayyar, Hallward-Driemeier, and Davies 2021). New forms of work, known as gig jobs, enabled by digital platforms, have now gained momentum (Eurofound 2020).

Das Werk untersucht anhand exemplarisch ausgewahlten Gigwork-Plattformen, inwieweit die Erkenntnisse aus den USA fur das deutsche Recht fruchtbar gemacht werden konnen, um einen besseren Schutz von Gigworkern zu erreichen. Obwohl Gigworker wegen ihrer strukturellen Unterlegenheit gegenuber den Plattformbetreibern schutzbedurftig sind, genugt das deutsche Recht diesem Schutzbedurfnis nicht. Auch die US-amerikanischen Faktor-Tests zur Abgrenzung zwischen Arbeitnehmern und Selbstandigen kommen bei Gigwork an ihre Grenzen. Der ABC-Test vermag zwar Gigworker zu erfassen, lasst sich jedoch nicht ohne systematische Bruche in das deutsche arbeitsrechtliche System ubertragen. Als Inspirationsquelle fur das deutsche Recht konnen aber die gesetzgeberischen und sonstigen Initiativen aus den USA dienen, die Gigworkern unabhangig von ihrem arbeitsrechtlichen Status gewisse Schutzrechte einraumen.
