Les biobanques constituées dans un but thérapeutique ou de recherche scientifique recouvrent une multitude de réalités. Elles sont porteuses de nombreux espoirs d’avancées tant scientifiques que médicales et sont au cœur de nouveaux enjeux. Au niveau juridique, leur création et utilisation engendrent des risques aigus d’atteinte aux droits des personnes concernées. Au niveau scientifique, elles nécessitent la mise en place de moyens techniques complexes. Afin de protéger les personnes dont le matériel biologique et les données y relatives sont stockés l’accent doit être mis sur le respect du principe de l’autonomie individuelle. L’étude de la législation européenne, française, et suisse a pour but de montrer les difficultés pour le consentement et l’information à jouer leur rôle traditionnel de garants du principe d’autonomie face aux possibilités d’utilisations prospectives des biobanques.
