Biotechnology and the Challenge of Property addresses the question of how the advancement of property law is capable of controlling the interests generated by the engineering of human tissues. Through a comparative consideration of non-Western societies and industrialized cultures, this book addresses the impact of modern biotechnology, and its legal accommodation on the customary conduct and traditional beliefs which shape the lives of different communities. Nwabueze provides an introduction to the legal regulation of the evolving uses of human tissues, and its implications for traditional knowledge, beliefs and cultures.

Bioprospecting, or the search for useful biochemical compounds and genes in nature, has been the focus of international negotiations for more than a decade, yet the debate on the terms for access to genetic resources, traditional knowledge and benefit-sharing is far from settled. This book examines the optimal property rights structures and institutional mechanisms for regulating bioprospecting for drug research. Focusing on the economics of contracts, it shows that the rights exchanged are complementary at each stage of drug discovery and the development of genetic resources.Defining and enfor

The Exploitation of Marine Genetic Resources in Areas beyond National Jurisdiction by Valérie Wyssbrod begins by identifying the legal regime applicable to these underexploited resources which offer vast potential for the development of new drugs, bioplastics, depolluting products and other innovations. The author then outlines provisions for a new treaty, currently under discussion at the UN and presents alternatives to a new regime including revised legal instruments, the development of soft law and the creation of an applicable ecolabel.
