Traditionally, the application of EU citizenship rights is conditioned on the existence of a cross-border element. In the two landmark decisions Rottmann and Ruiz Zambrano, the CJEU deviated from this traditional approach. According to this case law, EU citizens are protected by EU law in situations in which they lose their EU citizenship or are, in fact, forced to leave the territory of the Union even if they have not exercised their right to move. With this new doctrine, the step from the ”cross border paradigm” to the ”status paradigm” is taken. This study provides a doctrinal structure of the CJEU case law and explores the underlying general guarantee in order to clarify the scope and potential of this new concept in EU citizenship law. This book is therefore likely to be of interest to both practitioners and legal scholars.

What happens when the European Union sets new rules for the provision of cross-border healthcare services that once were conceived for the population living on the national territory ? Does Europe destabilize national social solidarity ? Do actors that govern the healthcare system further or resist the Europeanization of their national healthcare system ? Taking Austria, a prototypical Bismarckian healthcare system, as an example, this book aims at answering these questions by looking at how actors navigate between national institutional constraints and European opportunities. It presents how new rules on the provision of cross-border healthcare in the European Union have the potential of destabilizing national welfare boundaries. Taking a sociological approach to Europeanization, it is analysed if and how actors adapt to such new rules. An added value of the volume is to present the development of Austria's healthcare system in the "longue durée" through four political regime changes over the last 150 years, with European integration as the last wave of transformation to date. It shows that cross-border healthcare provision is already a well integrated practice ; and how providers and payers of healthcare deal with European requirements and voice their policy preferences in the Brussels arena. Overall, it suggests both the flexibility and the resilience of the national models of welfare.

Where do I belong? This is a question all mobile persons are bound to ask themselves at one time or another. When crossing borders, individuals establish links with States, which can be the basis for legal claims against these States. This book discusses the issue of these links and, more specifically, the question of how EU law defines the link needed to obtain the right to reside in a Member State and the right to social and employment protection in that State. When it comes to claiming rights from States, traditionally ‘nationality’ is the answer to the question where a person belongs. However, in the context of European integration and the development of an EU legal framework of internal market rules, citizenship rights and immigration rules, different answers to these questions have been developed. From this perspective the various chapters of this book examine instruments such as the Citizens Directive 2004/38, the Family Reunification Directive 2003/86, the Long-term Residence Directive 2003/109, the Social Security Coordination Regulation 883/2004, the Rome I Regulation 593/2008 and the Posting of Workers Directive 96/71. The case-law of the Court of Justice on these issues is of course a central element therein. The analyses of scholars from different legal disciplines in the fourteen chapters of this book show that EU law gives a multitude of answers to the question which link is necessary and sufficient to create an individual’s right vis-à-vis a State. The definition of this link, the criteria used and the legal consequences differ according to the legal framework the individual finds himself/herself in and the legal instrument he/she invokes. Moreover, the criteria used in legislation and case-law continue to be the subject of problems of interpretation and application, which in turn leads to legal uncertainty or even confusion.

Wie verlaufen die Migrationsprozesse von Frauen, die seit 1989 aus 13 EU- und Nicht-EU-Ländern Mittelosteuropas in Berlin als Arbeits-, Bildungs- und Heiratsmigrantinnen zuwanderten? Die Studie von Helga Jockenhövel-Schiecke zeigt die hohe Bereitschaft der Migrantinnen, das mitgebrachte kulturelle Bildungskapital sowie ihre Erwerbsorientierung zu erweitern. Beide sind charakteristisch für die Mittelschicht und prägen auch die mütterlichen Erziehungsstrategien. Der Untersuchung liegen biographische Interviews zugrunde, in denen die Frauen ihre Migrationsmotive, gendertypische Bildungs- und Erwerbsprozesse, transnationale Lebensformen und Gefühle ihrer multiplen Zugehörigkeiten beschreiben. Sie spiegeln so die Feminisierung der Zuwanderung aus Mittelosteuropa - auch bei Bildungsmigrantinnen.

Since the beginning of the economic crisis of 2008, Spain, like other southern European countries, has witnessed a mass departure of mostly young people looking for opportunities abroad. Leaving Spain is based on 58 autobiographical narrative interviews with recent Spanish migrants who went to the UK and Germany, and sometimes returned. By presenting a combination of in-depth case studies and comparative analyses, the author demonstrates the potential of biographical research and narrative analysis in studying contemporary Europe, including its overlapping crises. The scope of the sociological study is not limited to examining how those who left Spain experienced single phases of their migration. Instead, it focuses on the significance of migration projects in the context of their life histories and how they make sense of these experiences in retrospect. This book will not only be of great interest to social scientists and students in different disciplines and interdisciplinary studies such as sociology, anthropology, human geography, European studies, education, and social work, but also to professionals, European and national policy makers, and those interested in learning more about migrants’ experiences, perspectives, and (often invisible) contributions.

This open access book raises crucial questions about the citizenship of the European Union. Is it a new citizenship beyond the nation-state although it is derived from Member State nationality? Who should get it? What rights and duties does it entail? Should EU citizens living in other Member States be able to vote there in national elections? If there are tensions between free movement and social rights, which should take priority? And should the European Court of Justice determine what European citizenship is about or the legislative institutions of the EU or national parliaments? This book collects a wide range of answers to these questions from legal scholars, political scientists, and political practitioners. It is structured as a series of three conversations in which authors respond to each other. This exchange of arguments provides unique depth to the debate.
