Abstract

Seit nunmehr 60 Jahren prägen die Entscheidungen des Bundesverfassungsgerichts das Leben in der Bundesrepublik. Sie beeinflussen Gesetzgebung, vollziehende Gewalt und Rechtsprechung, sie strahlen in die gesamte Rechtsordnung aus und wirken auf allen Ebenen der Gesellschaft. Die wissenschaftlichen Mitarbeiterinnen und Mitarbeiter des Bundesverfassungsgerichts, die die Entstehung der Entscheidungen der Senate und Kammern begleiten, nehmen in der Reihe der Kommentatoren eine besondere Position ein. Sie sind aufgrund ihrer praktischen Tätigkeit prädestiniert, aus der Fülle der Entscheidungen erste Tendenzen oder gar ausgeprägte Linien in der Rechtsprechung des Gerichts zu erspüren, diese zu systematisieren und zu erklären. In diesem besonderen Blickwinkel auf die Arbeit des Bundesverfassungsgerichts liegt der Wert dieser Reihe. Band 2 greift weitere aktuelle Themen des Verfassungsprozessrechts, der Grundrechte und der Staatsorganisation auf und erörtert sie mit Bezügen aus der Praxis des Bundesverfassungsgerichts. Der Band erscheint zum 60jährigen Jubiläum der Arbeitsaufnahme des Bundesverfassungsgerichts im September 1951.

Abstract

Courts with the right to constitutional review exert considerable power in a political system. However, especially for Kelsenian constitutional courts there are hardly any large-N studies. This is mainly due to a lack of data. For the German Federal Constitutional Court, this gap has been closed by building a novel database, the development of which is depicted in this book. Employing data from this database, the occurrence of separate opinions in general and their different types in particular are analyzed. The book introduces a new, universal theory that reconciles and expands existing explanations. In a second step, the theory is applied to the German Federal Constitutional Court. It can be proven that one factor that has been neglected so far plays a decisive role: The judges' behavior depends on the profession they pursue after their time in office. Moreover, the study shows that -- contrary to the common literature -- it is not mainly the topic that determines a case's conflict potential but rather the number of issues a decision has to address.

Abstract

This open access book presents a topical, comprehensive and differentiated analysis of Germany’s public administration and reforms. It provides an overview on key elements of German public administration at the federal, Länder and local levels of government as well as on current reform activities of the public sector. It examines the key institutional features of German public administration; the changing relationships between public administration, society and the private sector; the administrative reforms at different levels of the federal system and numerous sectors; and new challenges and modernization approaches like digitalization, Open Government and Better Regulation. Each chapter offers a combination of descriptive information and problem-oriented analysis, presenting key topical issues in Germany which are relevant to an international readership. Sabine Kuhlmann is Professor of Political Science, Public Administration and Organization at Potsdam University, Germany, Vice President of the IIAS for Western Europe, and Vice-Chair of the National Regulatory Control Council of the German Federal Government. Isabella Proeller is Professor for Public and Nonprofit Management at the University of Potsdam, Germany. Dieter Schimanke is former Professor of Public Administration at the Helmut-Schmidt-University in Hamburg, Germany. He became Secretary of State in a state in East Germany after unification and since his retirement, he is Senior Expert in projects of GIZ on reforms of Public Administration (mainly in Eastern Europe and Asia). Jan Ziekow is Professor of Public Law and the Director of the German Research Institute for Public Administration, Germany, Vice-President and former President of the German Section of IIAS.
