En Suisse, la démocratie directe ne se caractérise pas seulement par la grande variété de ses institutions et par la richesse croissante de ses expériences pratiques ; elle se distingue également par la surveillance constante et attentive que le juge constitutionnel exerce sur son appareil institutionnel et sa pratique socio-politique.Or, malgré son originalité et son importance, la dimension juridictionnelle fédérale et surtout cantonale des droits populaires na pas été intégrée de manière systématique dans lanalyse de la démocratie directe en Suisse. Cest cette lacune que cherche à combler le présent ouvrage. Sur la base dun important travail de recensement et de synthèse des arrêts du Tribunal fédéral et des différentes auto-rités de recours des vingt-six cantons, létude proposée mesure linfluence prépondérante du juge sur les instruments et le fonctionnement de la démocratie directe.En confrontant juridiction constitutionnelle et démocratie directe, lauteur touche au nerf central de lorganisation de lÉtat helvétique.

Abstract

This book outlines the constitutional systems of the six Australian states and ten Commonwealth territories. It begins with their history, basic features, role and future within the Australian federation. Its primary focus is on the binding constitutional restrictions which impact on their parliaments and governments. These issues are also dealt with in relation to the three self-governing territories of the ACT, the Northern Territory and Norfolk Island. It is the only Australian legal reference work of its kind which deals specifically with the constitutional systems of the states and territories. Abstract

The first five editions of this well established book were written by Colin Turpin. This new edition has been prepared jointly by Colin Turpin and Adam Tomkins. This edition sees a major restructuring of the material, as well as a complete updating. New developments such as the Constitutional Reform Act 2005 and recent case law concerning the sovereignty of Parliament, the Human Rights Act, counter-terrorism and protests against the Iraq War, among other matters, are extracted and analysed. While it includes extensive material and commentary on contemporary constitutional reform, Turpin and Tomkins is a book that covers the historical traditions and the continuity of the British constitution as well as the current tide of change. All the chapters contain detailed suggestions for further reading. Designed principally for law students the book includes substantial extracts from parliamentary and other political sources, as well as from legislation and case law. As such it is essential reading also for politics and government students.
