Abstract

With the increased mobility and interdependence brought on by globalisation, governments can no longer deal effectively with what were traditionally regarded as «domestic issues» unless they cooperate among themselves. International law may once have been a sort of inter-state law concerned mostly with relations between states, but it now looks increasingly inside state borders and has become, to a large degree, a trans-governmental law. While this creates significant challenges even for highly-unified «nation-states», the challenges are even greater for federations in which powers have been divided up between the central government and federated states. What roles should central governments and federated states play in creating and implementing this new form of governance? Using the Canadian federation as its starting point, this case study illustrates a range of factors to be considered in the appropriate distribution of treaty powers within a federation. Professor Cyr also shows how - because it has no specific provisions dealing with the distribution of treaty powers - the Canadian constitution has «organically» developed a tight-knit set of rules and principles responding to these distributional factors. This book is therefore both about the role of federated states in the current world order and an illustration of how organic constitutionalism works.

Abstract

Mexico's economy has grown moderately over the last quarter century, with annual per capita GDP growth averaging just 1.2 percent between 1990 and 2017. The country's weak economic performance reflected a decline in productivity, which fell by 8 percent during that period. Mexico's productivity challenges are associated with large and widening regional disparities and the misallocation of resources between sectors and firms. Large productive firms integrated with Global Value Chains have not developed backward linkages to the rest of the economy and lagging regions. Meanwhile, widespread labor and firm informality contributes to the misallocation of productive resources. Reversing the decline in productivity will require an integrated strategy encompassing multiple policy areas and sectors. This broad strategy should include strategies discussed in other policy notes: (i) alleviating rigidities and distortions in labor markets and improving access to credit; (ii) alleviating existing rigidities and obstacles to competition across sectors and sub-sectors while following through with the structural reforms enacted; (iii) designing and implementing effective interventions at the subnational levels to enhance both product and factor markets; (iv) dealing with the financing of social insurance schemes; and (iv) strengthening rule of law institutions at the federal and local levels. This note focuses on critical aspects of the diagnostic around the productivity dynamics in Mexico. It also links the aspects of the strategy above-highlighted to specific policy recommendations on other Policy Notes of this set given the cross-cutting nature of productivity growth. It also focuses on providing policy directions on: (i) strengthening institutions and programs working directly on the productivity agenda; (ii) selected sub-national interventions to ease the regulatory burden; and (iii) proposing a broad and integrated strategy for fostering formalization.

Abstract

With the adoption of federalism through the 2015 Constitution, seven newly created provincial and 753 local governments are now placed at the frontline, tasked to manage substantial amount of public resources and deliver critical services to citizens. As result, Nepal is now in the middle of the transition to federalism, and it is understandable that the process will be a drawn-out one, which could take decades. This policy note has been prepared based on the findings, analyses and recommendations of the Federalism Capacity Needs Assessment (FCNA) study. The FCNA was conducted by the Georgia State University in 2018-2019 for the government of Nepal (GoN) with the joint support of the World Bank and UNDP. It has identified the gaps between the needs and the capacity in different levels of government. This note provides a synthesis of the FCNA findings as well as its forward-looking recommendations in terms of actions the government could take in the immediate, medium and long-terms towards a full realization of the benefits of federalism implementation in Nepal.

Abstract

We assess the extent to which fiscal transfers smooth regional shocks in three large federations: the U.S., Canada, and Australia. We find that fiscal transfers offset 4-11 percent of idiosyncratic shocks (risk-sharing) and 13-24 percent of permanent shocks (redistribution). This fiscal insurance largely operates through automatic stabilizers embedded in a central budget primarily through federal taxes and transfers to individuals, rather than transfers from the central government to state budgets. These results have implications for the design of fiscal risk-sharing mechanisms in the euro area.

Who and what a government taxes, and how the government spends the money collected, are questions of primary concern to governments large and small, national and local. When public revenues pay for high-quality infrastructure and social services, citizens thrive and crises are averted. When public revenues are inadequate to provide those goods, inequality thrives and communities can verge into unrest-as evidenced by the riots during Greece's financial meltdown and by the needless loss of life in Haiti's collapse in the wake of the earthquake. In The Public Good and the Brazilian State, Anne G. Hanley assembles an economic history of public revenues as they developed in nineteenth-century Brazil. Specifically, Hanley investigates the financial life of the municipality-a district comparable to the county in the United States-to understand how the local state organized and prioritized the provision of public services, what revenues paid for those services, and what happened when the revenues collected failed to satisfy local needs. Through detailed analyses of municipal ordinances, mayoral reports, citizen complaints, and financial documents, Hanley sheds light on the evolution of public finance and its effect on the early economic development of Brazilian society.
