Depuis les années 1990, la notion de cosmopolitisme est devenue un objet d'analyse privilégié pour la philosophie politique, tandis que les réseaux de solidarité transnationale, les problèmes liés aux risques globaux et le développement des modalités de gouvernance supranationale ont donné une pertinence nouvelle au concept de citoyenneté mondiale. Aujourd'hui, la perspective cosmopolitique ne désigne plus seulement une façon de se représenter en tant qu'individu dans le monde, mais aussi une manière de concevoir la politique au-delà de la sphère nationale. Dans le cadre des débats autour d'une possible démocratisation du pouvoir à l'échelle supranationale, le cosmopolitisme propose des réponses originales, qui n'échappent pas à des critiques radicales. Cet ouvrage analyse cette perspective et certaines de ces critiques.

This book investigates how liberal parties have evolved over time as a party family, in a comparative perspective. Through a discussion of the applicability of the concept of party family to liberal parties, it gives a better picture of the development, challenges, and opportunities for liberal parties in Europe.The history of liberal parties in Europe is peculiar and the origins of the liberal family are not clearly defined. Liberal parties are still quite heterogeneous given the various meanings embraced in the idea of liberalism, including economic liberalism, cultural liberalism, progressivism, social-liberalism. Bringing together the best specialists engaged in the study of liberal parties, and with a two-levels perspective (comparative and case study), this book renews and expands our knowledge on the liberal party family in Europe. Four major themes are developed, linked to the four approaches of the concept of party family: electoral performances, participation to power, ideology and political program, and party organization. These themes are systematically developed in case studies, and in comparative chapters.Primarily aimed at scholars and students in comparative politics, this book should especially appeal to scholars in the fields of political parties and party systems, representation and elections, voting behavior, and public opinion. In the European Union the Return Directive aims at establishing common standards and procedures to be applied in Member States for returning illegally staying third-country nationals. An entry ban prohibits entry into and stay on the territory of all EU Member States (except the United Kingdom and Ireland) and Switzerland, Norway, Iceland and Liechtenstein. This instrument is intended to have preventive effects and to foster the credibility of EU return policy. The clear message is that those who disregard migration rules in the Member States will not be allowed to re-enter any Member State for a specified period. Furthermore, the entry ban is an instrument which can be used to prevent or to counter terrorism. The use of criminal sanctions in the area of immigration opens the largely political debate on the legitimacy of the process of criminalizing foreigners. The merger between criminal law and immigration law has been classified as "crimmigration law". The entry ban falls within the scope of crimmigration law. The relation between immigration law and criminal law and the compatibility of national penal measures imposed as a punishment for illegal migration is developed in the case law of the Court of Justice of the European Union. There is a well-established jurisprudence on the interplay between domestic penal sanctions and the effectiveness of return policy. The effectiveness of the return process would be compromised by the application of a criminal penalty for violating the entry ban, because the primary objective of the Directive is not to prevent illegal presence in the territory but rather to put an end to it. The current issue is to determine to what extent the use of criminal sanctions by Member States is allowed in the situation that an entry ban is issued against an illegally staying third-country national. This research focuses on this issue.

The European Union has increasingly taken on a role as international security provider that extends beyond the geographical scope of its membership. This is clear from the wide range of military and civilian crisis management missions that the Union has undertaken, but also identifiable through its other policies, such as the European Neighbourhood Policy and development assistance, which have also to some extent become security focused. Yet, the role of the EU as an international security provider remains under-theorized and weakly understood. The proposed book analyses the Union’s role as an international security provider in a comprehensive way developing theoretical as well as empirical grounding for the understanding of the making and implementation of EU security policy. The contributions in this book cover actors involved in the policy making process, the dynamics of this process itself, its outcomes (strategies and policies) and their impact on the ground. They examine the relevance of, and apply, existing theories of international relations, international security and foreign policy analysis to the specific case of the EU, investigate empirically how particular policies are formulated and implemented, and study the impact and effectiveness of the Union as an international security provider in a variety of cases compared. This handbook proposes an introduction to the EU’s Environmental Law and it is thus primarily intended for students, legal practitioners and environment-specialized engineers and other technicians. European environmental law remains strongly under the influence of its initial market-oriented legal framework in spite of the progress accomplished by the common environmental policy. Environmental governance and management operate within a complex primary law framework, within which conciliation must be made between economical and environmental objectives around such concepts as the quest for a high level of protection and sustainable development. A description of that decisive institutional framework provides the starting point for a synthetic and dynamic presentation of the hundreds of secondary law measures which provide parameters for human activities, from the main areas of natural environments to the objects impacting thereon, the means to implement them or economic instruments such as greenhouse gas emission allowances ou the producer’s responsibility extended to the end-oflife of his products. As to the integration of environmental requirements into other policies, it resolves arising conflicts with market rules and sectorial policies, especially in the agricultural, transports, energy and health areas.This handbook includes a description of the impact of the Paris Agreement on climate change on EU law, including the two “legislative packages” and the new “Governance of the Energy Union“ proposed by the Commission.

This Casebook deals with the horizontal effects of EU law, which is to say its effects on relationships between individuals. To a large extent, these effects have been created by the Court of Justice of the European Union (CJEU) on the basis of the European Treaties. The main focus of the Casebook is on the developments relating to primary EU law and their influence on national private law. It studies instances where EU primary law has already directly or indirectly influenced the case law in the Member States, or where it is expected to do so soon. Compared to the well-known impact of EU directives on private law, these developments concerning primary EU law are hardly noted by private lawyers and perhaps not sufficiently explained by scholars of EU law. Therefore the book makes an important contribution to scholarship and education. This book highlights developments in the areas of competition law, fundamental freedoms, non-discrimination, general principles of EU law, ex officio application of provisions of EU law and implementation of directives, including harmonious interpretation and Francovich liability.
