Cet ouvrage issu d'un colloque organisé par l'Association Louis Chatin pour la défense des droits de l'enfant le 13 juin 2016 a pour thème « les enfants non accompagnés », ceux que l'on nomme aussi « les mineurs étrangers isolés ». L'objectif est d'exposer l'état du droit, et les bonnes pratiques en France et en Europe. L'état du droit, première partie de l'ouvrage permet de faire le point à la fois sur les textes internationaux et européens et sur le droit français interne. La Convention des Nations Unies relative aux droits de l'enfant de 1989 (CIDE), la Convention de La Haye du 19 octobre 1996 sur la protection des enfants, sont des instruments essentiels pour les enfants non accompagnés, spécifiques aux enfants, à la différence de la Convention du 28 juillet 1951 relative aux réfugiés. Ces instruments ratifiés par tous les Etats européens forment le socle de la protection des enfants non accompagnés. Le droit français, qui semble se focaliser sur les examens osseux, ne respecte pas les principes énoncés par la CIDE. La défenseure des enfants, adjointe du Défenseur des droits, la présidente de la CNCDH le constatent dans leurs contributions. La seconde partie de l'ouvrage se veut plus positive en exposant les bonnes pratiques pour accueillir ces enfants, les bonnes pratiques internationales, les bonnes pratiques en Europe avec les exemples de la Suisse et des Pays-Bas, et aussi, les bonnes pratiques en France, où certains départements tentent d'innover. Depuis un an, la situation des mineurs non accompagnés en France n'a guère évolué et tout ce qui est exposé ici reste malheureusement d'actualité. La « jungle » de Calais a été démantelée sans que la question de ces enfants ne soit réglée.
