The European Group on Tort Law presents the results of its extensive research project, the Principles of European Tort Law. They were drafted on the basis of several comparative studies on the most fundamental questions of tortious liability and the law of damages. The Principles are not a mere restatement of the common core of tort law in Europe, but rather a proposal for a comprehensive system of tortious liability for the future, though necessarily linked to existing regimes. They are meant to stimulate discussion both among academics and practitioners and could serve as guidelines for national legislatures, thereby fostering gradual harmonization. The text of the Principles, which is offered in English and several other languages, is accompanied by commentaries on the various parts elaborating their intended meaning and interplay.

Can children, in spite of their lack of tortious capacity, for reasons of equity be held liable in exceptional conditions? What is the relationship between liability of children and liability of their parents or guardians? Are these questions answered by special rules of general application in all fields of tort liability or are there specific rules for specific torts? The book includes reports from 11 EU Memb

Recently, mankind is not only suffering from all kind of natural catastrophes (earthquakes, flooding, storms or volcanoes), but increasingly also from so-called man-made disasters, including technological disasters such as explosions, but obviously also terrorism. In recent years many European legal systems have tried to come up with a specific protection for victims of catastrophes. Some countries have created a specific fund solution; others follow a generous ad hoc approach whereby large amounts of compensation are made available on an ex post basis. This book shall pay attention to all of

In this work Dr. Taylor surveys the federal countries of the world and asks how they divide power among the constituent units of the federation. In so doing, he considers not only the formal constitutional text, but, far more importantly, the case law that has grown up around it as the Courts develop approaches to interpreting provisions for the distribution of powers. This enables conclusions to be drawn about the effectiveness of various structural and interpretative approaches to the distribution of powers within federations.

There is still much to learn about fundamental aspects of employment discrimination law as a social system. What drives the growing demand for litigation? To what extent does discrimination persist in subtle but pervasive forms and what explains how it varies by organizational and market context? How do different groups of workers perceive the extent to which they are discriminated against and what, if anything, do they do about it? How have employers responded to discrimination law? How is employment discrimination law affected by broader political and legal currents? What is the relationship between anti-discrimination law and patterns of social inequality? The chapters in this unique collection grapple with many of these issues. Questions of this scope require interdisciplinary scholarship; and this book includes original contributions from many of the legal scholars, economists, psychologists, sociologists, political scientists, and historians who are at the forefront of new research on discrimination and law. The Handbook of Employment Discrimination Research encompasses critical discussions across different social science disciplines, as well as between legal scholars and social scientists. As a collection, it suggests a broad reconsideration of employment discrimination and its treatment in law.
