Le présent volume contient les rapports écrits des orateurs de la conférence du 12 décembre 2005, donnée à l'ULB dans le cadre du cycle UB3, abordant des aspects d'actualité du droit de quelques contrats spéciaux. M. François Glansdorff, avocat et professeur à l'ULB, coordinateur de la conférence, fait la synthèse des actions ouvertes à l'acheteur insatisfait de la chose vendue, allant des actions traditionnelles du Code civil jusqu'à la récente loi sur la vente des biens de consommation (en ce compris quelques questions que le praticien ne manquera pas de se poser). La stabilité de la loi sur les baux commerciaux confère une importance particulière à la jurisprudence qui la concerne, et en particulier à la jurisprudence de la Cour da cassation. M. Lucien Simont, avocat à la Cour de cassation et professeur émérite à l'ULB, fait ici l'analyse de cette jurisprudence la plus récente, dans le prolongement du dernier examen auquel il a contribué, à la Revue critique de jurisprudence belge. MM. Paul-Alain Foriers, avocat et professeur à l'ULB, et Rafaël Jafferali, avocat et assistant à l'ULB, font ensuite un examen complet de la jurisprudence en matière de mandat, sur une large période (1991 à 2004). Leur étude se situe également dans le prolongement du dernier examen de jurisprudence que L. Simont et P-A. Foriers avaient consacré, au mandat notamment, dans la RCJB en 2001.
