Abstract

"When can a state give political support to a military intervention in another state? The Government of the Netherlands commissioned an Expert Group to examine this complex, topical and time-sensitive question and to consider whether it should press for international acceptance of humanitarian intervention as a new legal basis for the use of force between states in exceptional circumstances. This volume is the result of those efforts. The Expert Group was led by Professor Cyrille Fijjnaut and consisted of Mr. Kristian Fischer, Professor Terry Gill, Professor Larissa van den Herik, Professor Martti Koskenniemi, Professor Claus Kress, Mr. Robert Serry, Ms. Monika Sie Dhian Ho, Ms. Elizabeth Wilmshurst and Professor Rob de Wijk. Examiner les crimes de guerre, les crimes contre l'humanité et le crime de génocide à la lumière de la norme impérative du droit international, c'est placer la protection de la personne humaine au coeur du droit aussi bien en temps de crise (guerre, catastrophes naturelles) qu'en temps de paix, en vue de jeter les fondations d'un nouvel ordre humanitaire international, de gré ou de force. Quatre variables justifient la grille de lecture portant sur les nouveaux aspects du droit international : sanctionner les crimes internationaux ; se servir de l'ingérence humanitaire et judiciaire comme levier du droit et du devoir de l'humanité (droit international humanitaire) ; réaffirmer la primauté à la norme impérative de droit international ou le jus cogens ; pratiquer le réalisme juridique, c'est-à-dire mettre la force au service du droit et de la justice internationale.
