Les colonies européennes modernes et contemporaines, dès le XVIe siècle, voient classiquement se juxtaposer juridictions ordinaires et juridictions d'exception ou spécialisées. Cependant, les tribunaux coloniaux y prennent souvent la forme de l'extraordinaire parce que le droit colonial est sui generis un droit d'exception qui oblige à un pluralisme, donc à des inégalités juridiques : tribunaux indigènes, juridictions inconnues en métropole ou spécialement adaptées aux sociétés et espaces coloniaux, instances militaires aux compétences étendues à la société civile, tribunaux ad hoc en charge de la répression d'affaires coloniales particulières, etc. La justice coloniale est un phénomène complexe dans lequel luttent ou s'épaulent volontiers les autorités judiciaires, administratives et politiques : étudier la juridiction d'exception dans les colonies d'Ancien Régime et du second empire colonial (XIXe-XXe siècles) permet de mieux comprendre un phénomène de domination.

A new edition of this work was made necessary by the numerous changes to the law of costs related to contentious jurisdiction since the Reform Act on Proceedings in Family Matters and Matters of Non-Contentious Jurisdiction (FFG-Reform) came into effect on 1 September 2009. The well-established standard reference work on the law of costs contains commentary on the Court Fees Act (GKG) as well as the Act on Court Fees in Family Law Matters (FamGKG), including costs schedule and expenses. The founding of a constitutional court is often an indication of a chosen path of constitutionalism and democracy. It is no coincidence that most of the constitutional courts in East and Southeast Asia were established at the same time as the transition of the countries concerned from authoritarianism to liberal constitutional democracy.
