Abstract

The first edition of The American Convention on Human Rights showed the hesitant steps of a court trying to find its way in a region plagued by egregious human rights violations, the absence of democracy and a significant disregard of international human rights norms. The second edition followed this up by introducing an analysis of the advancement in the reasoning of the Court regarding the violations that it had been dealing with since its inception.This, now co-authored, third edition contains an updated and in-depth analysis of the norms applied by the Inter-American Court of Human Rights to deal with the most frequent human rights violations that still occur in Latin America regarding life, humane treatment, personal liberty, due process, access to justice, the principle of legality and judicial protection. The second edition contained a chapter on disappearances, as the Court at the time had significantly developed its reasoning on the matter; this third edition shows the latest evolution on the subject, which still plagues the region. In addition, a new chapter examines discrimination, an issue that has emerged as a frequent and important concern in the Court’s work.This edition also reflects the dynamic development of the Court’s work in recent years, which has evolved to a more refined jurisprudence covering more specific aspects of the rights examined and topics not previously addressed. These include, inter alia, the justiciability of social, economic, cultural and environmental rights; the recognition of collective rights holders and State responsibility for gender-based torture committed by private actors. These advances are the result of considerable progress in the democratization and embrace of human rights in the countries under the Court’s jurisdiction.

Abstract

Sorti en septembre 2020, cet ouvrage méritait rapidement une deuxième édition. Non pas que le " fil rouge " qui en constitue l’armature ait été désavoué, bien au contraire. Lors des deux années écoulées, la souveraineté fut plus que jamais " déchaînée " (R-J Dupuy) en malmenant les bénéfices du multilatéralisme et en défiant les acquis en matière de protection des droits de l'homme. Il fallait alors intégrer les développements les plus saillants qui se sont manifestés jusqu’à la fin du mois de décembre 2022. Deux électrochocs politiques confirment la thèse de cet ouvrage : la guerre en Ukraine et l’exclusion corrélative de la Russie de Vladimir Poutine du Conseil de l’Europe ; la réapparition de la terreur au Nicaragua et la dénonciation, par le gouvernement de Daniel Ortega, de la Charte de l’Organisation des États américains. La souveraineté n’est certainement pas morte. Elle se manifeste de façon paroxystique avec son lot de désolation. Sur un plan plus général, il fallait actualiser, au fil de l'eau, les éléments les plus significatifs relatifs au fonctionnement des 3 Cours, mentionner les approches jurisprudentielles les plus marquantes, intégrer des analyses doctrinales novatrices. L'histoire humaine du XXIème siècle renoue avec l'absolutisme, l'autoritarisme, la violence. Les acquis issus de la fin de la IIème guerre mondiale s'effritent devant la volonté d'autocrates qui n'ont, pour seule imagination, que la prédation. Gageons que celles et ceux pour qui la force de l'imagination se situe ailleurs, puissent faire entendre leur voix. L'Humanité mérite d'être à la hauteur des urgences sociales et environnementales.

Abstract

The American Convention on Human Rights was adopted in 1969, and has been ratified mostly by Latin American States, with 23 States Parties. This commentary provides an understanding of how the human rights protected by this treaty have been interpreted in the various cases examined by the protection bodies, the Inter-American Commission on Human Rights and the Inter-American Court of Human Rights. It also explains the workings of the protection system, including the individual complaints mechanism.
