Constitutionalism under Stress reflects on comparative constitutionalism in Central and Eastern Europe through the lens of leading legal scholar Professor Wojciech Sadurski, whose writings have anticipated and scrutinized the current decline of liberal democracies and populist challenges to the rule of law in the region.0Sadurski's work has chronicled the transition from concern for the most basic of human rights under authoritarian rule to the challenges of democratic governance. The compelling rights discourse of an earlier period gave way to claims of abuse of majoritarian prerogatives as the hopes of liberal democracy encountered the power of illiberalism. The theoretical responses offered for the preservation of liberal democracy, in light of the current turbulence regarding the rule of law in the region, produces a far reaching and effective reference tool on matters of constitutional capture and illiberal democracy.

La Cour suprême des Etats-Unis au début du XIXe siècle et les cours constitutionnelles de l'Autriche de l'après première guerre mondiale, de l'Allemagne et de l'Italie de l'après seconde guerre mondiale, ont mis en oeuvre, chacune à sa manière, des formes de contrôle de constitutionnalité de la loi qui sont apparues comme des référents de la démocratie constitutionnelle occidentale et des principales étapes de son émergence. Mais où en sont aujourd'hui ces modèles du constitutionnalisme "classique" ? C'est à l'examen fouillé de la jurisprudence constitutionnelle de ces vingt-cinq dernières années dans ces différents pays que se sont livrés - en langue anglaise ou française - les auteurs de ce volume, qui se sont aussi intéressés à d'autres cadres nationaux, comme ceux de certains Etats nordiques (Pays-Bas, Danemark, Islande), ou encore comme celui, plus problématique puisque officiellement dépourvu de constitution écrite, de la Grande-Bretagne. Grâce à ces analyses, il est possible de mieux prendre la mesure des altérations subies par ces modèles du constitutionnalisme.
