"Comparative law of religions has developed in recent years as a new discipline at the intersection of legal and religious science, of theology and anthropology. This book presents a systematic theoretical basis for this new discipline. While law is mostly associated with the state, many religions also have their own internal law. These internal legal norms are aimed at a particular form of behaviour on the part of believers. They therefore play a particular role in conflicts arising today between certain religious forms of behaviour. The comparison of the internal law of religions serves to establish and explain the commonalities and differences between various religious legal traditions. The religions examined here include: the law of Christian denominations, Jewish law, Islamic law, Hindu law, Buddhist law, and other religious legal systems. The work assesses six current approaches to the comparative law of religions, evaluating their strengths and weaknesses, leading to the development of a new approach. The book discusses the role of religious law in state law and looks to likely future developments"--

Contributors to The Divine Courtroom in Comparative Perspective treat one of the most pervasive religious metaphors, that of the divine courtroom, in both its historical and thematic senses. The ecumenical movement, with its historical theological focus, has failed to-date to address the role of church law in shaping relations between churches and fostering greater mutual understanding between them. In turn, theologians and jurists from the different traditions have not hitherto worked together on a fully ecumenical appreciation of the potential value of church laws to help, and sometimes to hinder, the achievement of greater Christian unity. This book seeks to correct this ecumenical church law deficit. It takes account of the recent formulation by an ecumenical panel of a Statement of Principles of Christian Law which has been welcomed by Pope Francis and the Ecumenical Patriarch of Constantinople, leader of the Orthodox Church worldwide, as recognizing the importance of canon law for ecumenical dialogue. This book, therefore, provides not only the fruits of an understanding of church laws within ten Christian traditions, but critically evaluates the Statement against the laws of these individual ecclesial communities.

Die Vollendung des 65. Lebensjahres nehmen Kollegen und Schüler zum Anlass, den Professor für Kirchenrecht an der Universität Innsbruck, Wilhelm Rees, mit einer Festschrift zu ehren und sein wissenschaftliches Wirken im Bereich des Kanonischen Rechts zu würdigen. Die Festschrift trägt den Titel »Rechtskultur und Rechtspflege in der Kirche«. Sie soll auf diese Weise zentrale Anliegen widerspiegeln, denen sich Wilhelm Rees in seiner wissenschaftlichen Arbeit und in der Mitwirkung am Leben der Kirche in hohem Maße verpflichtet sieht. Bei der kritischen Analyse der kirchlichen Ordnung und der kommentierenden Begleitung der kirchlichen Gesetzgebung tritt er immer wieder dafür ein, dem Ideal der Gerechtigkeit gemäße Lösungen zur Geltung zu bringen. Auch für die praktische Arbeit eines Kirchenrechtlers ist Rees sich nicht zu schade und leistet als Berater und Beistand rechtssuchenden Menschen seine kundige Unterstützung. The Qur'ān, emphasizing ritual purity and the role of Jesus as giver of God's positive law, preserves aspects of an earlier Jesus movement that most Christian groups diluted or rejected. The Didascalia Apostolorum, a late ancient church order, records a significant number of the laws promulgated in the Qur'ān, but does not fully endorse them when it comes to purity. Likewise, the Didascalia' legal narratives about the Israelites and about Jesus, as well as the legal and theological vocabulary of the Syriac (Eastern Christian Aramaic) version of the Didascalia, recurrently show kinship with the Arabic Qur'ān, amplifying the apparent affinities between the two texts. The Qur'ān, however, is not "based" on the Didascalia in any direct way; detailed comparison of the two documents illustrates the absence of textual influence in either direction. Both texts should rather be read against the background of the practices and the oral discourse shared by their respective audiences: a common legal culture. In this volume, Holger M. Zellentin offers new insights into Late Antique Judaism and Christianity, into the continuity of Judaeo-Christian law and narrative within Jewish and Christian mainstream communities past the fourth century, and into the community that the Qur'ān first addressed. Understanding how the Qur'ān parts ways with contemporaneous forms of Christianity and Judaism, both in the initial and in subsequent phases of the internal development of its legal culture, allows for a more precise appreciation of its message.
