After Lisbon, European integration has moved towards new and more ambitious objectives, with the aim of strengthening the Union's institutional architecture as well as rationalising and legitimising its legal order.Within this broad context, the making of European private law is a challenge that faces basic questions, such as:"Why European private law is needed?","How European private law could and should be set up?","What areas, to what extent and what policy objectives could and should be involved?" and"Who carries the responsibility of making it?".The book, through a variety of thematic contributions, offers several *nsights for a wide-ranging reflection on such issues, together with a more specific analysis of the most recent Commission's proposal for a regulation on a "Common European Sales Law" (CESL). Die Vorbereitungen laufen bereits viele Jahre, nun liegt er endlich vor: der Entwurf der Europäischen Kommission für ein Gemeinsames Europäisches Kaufrecht als Optionales Instrument. Beteiligte an den Vorarbeiten und wichtige Kritiker derselben setzen sich in diesem höchst empfehlenswerten Buch mit dem Kommissionsentwurf auseinander. Wie wird die Harmonisierung des europäischen Vertragsrechts durch den Entwurf vorangetrieben? Wie "schlägt" sich der Entwurf im Vergleich zum BGB, zum DCFR oder zu den Acquis-Principles? Beleuchtet werden insbesondere Irrtumsanfechtung, AGB-Kontrolle, allgemeines und besonderes Leistungsstörungsrecht beim Kauf und bei verbundenen Dienstleistungen sowie übergreifende Fragestellungen zum Verbraucherrecht. Der Band wird abgerundet durch eine Synopse des Kommissionsentwurfs und der vorangegangenen Machbarkeitsstudie, in der die Entwicklung des Textes deutlich wird.

Torsten Korber untersucht und verdeutlicht den Einfluss der Grundfreiheiten des EG-Vertrages (Warenverkehrs-, Dienstleistungs-, Personenverkehrs- und Kapitalverkehrsfreiheit) auf das deutsche Privatrecht und den Privatrechtsverkehr. Zu diesem Zweck analysiert der Verfasser die rechtlichen und wirtschaftlichen Strukturen des Europaischen Binnenmarktes als Spielfeld fur Zusammenspiel und Konflikt von Grundfreiheiten und Privatrecht. Darauf aufbauend systematisiert er die EuGH-Rechtsprechung, um die immer noch ausserst undeutlichen Konturen der Grundfreiheitendogmatik zu scharfen. In der Vergangenheit eingetretenen Fehleinschatzungen wird durch eine klare und enge Fassung der Verbotsreichweite begegnet. Auf dieser Grundlage werden die Aspekte positiver und negativer Einwirkung der Grundfreiheiten auf die Setzung, Auslegung und Anwendung staatlichen Rechts durch Gesetzgeber und Zivilgerichte der Mitgliedstaaten verdeutlicht. Zahlreiche Beispiele aus dem materiellen und internationalen Privatrecht verdeutlichen die gewonnenen grundsatzlichen Erkenntnisse. Schwerpunkte bilden das Wettbewerbs- und Gesellschaftsrecht sowie das deutsche IPR. Abschliessend geht der Autor der unmittelbaren Einwirkung der Grundfreiheiten auf den Privatrechtsverkehr (d.h. ihrer unmittelbaren Drittwirkung) nach.

As the European Union (EU) matures, there is an increasing debate, partly fuelled by fierce national criticism offered by Eurosceptic politicians, partly initiated by the EU institutions themselves, on the way in which the EU has developed and what the EU must look like in the future. This debate includes a discussion on one of the core aspects of European integration: at which level should the rules be set and who decides where the authority to do so should lie? Private law has an important role to play in this discussion. Many private law rules touch on the core of the internal market as they serve to foster trade or to offer protection to market participants, such as consumers. In 2011, the Maastricht European Private Law Institute (M-EPLI) was founded. M-EPLI researchers combine European Private Law scholarship in the fields of contract, property, commercial and procedural law as well as legal theory.
