Abstract

This study provides a useful overview of cross-border cooperation in the area of healthcare initiatives. It outlines how European health policy has developed through the different European Treaties. This study also provides a number of good examples of fruitful cross-border cooperation between countries and regions that illustrate that collaboration on healthcare between EU countries is worthwhile for everyone. Among many cross-border projects it puts particular emphasis on the mutually beneficial collaboration in the border region between Belgium and France. 1. Abstract

Where do I belong? This is a question all mobile persons are bound to ask themselves at one time or another. When crossing borders, individuals establish links with States, which can be the basis for legal claims against these States. This book discusses the issue of these links and, more specifically, the question of how EU law defines the link needed to obtain the right to reside in a Member State and the right to social and employment protection in that State. When it comes to claiming rights from States, traditionally 'nationality' is the answer to the question where a person belongs. However, in the context of European integration and the development of an EU legal framework of internal market rules, citizenship rights and immigration rules, different answers to these questions have been developed. From this perspective the various chapters of this book examine instruments such as the Citizens Directive 2004/38, the Family Reunification Directive 2003/86, the Long-term Residence Directive 2003/109, the Social Security Coordination Regulation 883/2004, the Rome I Regulation 593/2008 and the Posting of Workers Directive 96/71. The case-law of the Court of Justice on these issues is of course a central element therein. The analyses of scholars from different legal disciplines in the fourteen chapters of this book show that EU law gives a multitude of answers to the question which link is necessary and sufficient to create an individual's right vis-à-vis a State. The definition of this link, the criteria used and the legal consequences differ according to the legal framework the individual finds himself/herself in and the legal instrument he/she invokes. Moreover, the criteria used in legislation and case-law continue to be the subject of problems of interpretation and application, which in turn leads to legal uncertainty or even confusion.'[...] the book significantly elevates the discussion around EU (social) law as it [applies] to mobile persons, focusing on some of the most important aspects of a person's life, such as residence, unity with family members, employment and social (rights) protection. Abstract

Les frontières communes entre pays favorisent les mouvements de travailleurs. Cette situation a un impact évident en droit du travail : elle réduit le coût du travail, c’est-à-dire les charges sociales et salariales, augmente la compétitivité des entreprises et, en même temps, attire les investissements et crée des emplois. Il est dès lors tentant pour les entreprises de faire appel à des travailleurs étrangers en ne respectant pas les conditions de travail et de rémunération. Beaucoup de gouvernements envisagent d’ailleurs d’intensifier la lutte contre ce qu’il est convenu d’appeler le dumping social. 0Le présent ouvrage, avec ce sujet d’actualité brûlante pour toile de fond, a pour objet d’étudier plus particulièrement les fiches de paie en Belgique et en France. 0Après une introduction contextuelle, la notion de rémunération, recouvrant des réalités différentes selon les pays, constitue le thème abordé dans la première contribution. La seconde contribution présente un exposé comparatif des fiches de paie. Celles-ci sont ensuite soumises à l’examen dans le cadre du salary split, système de répartition de la rémunération entre deux États, fondé sur des prestations effectives. La matière du détachement est par ailleurs abordée, avec son impact à la fois en droit de la sécurité sociale et en droit du travail. Abstract

The issues of patient mobility have been high on the EU's political agenda for the last two decades. However, the adoption of the Patient Mobility Directive, which had to be implemented by the Member States by 25 October 2013, added to the complexity of an already complex legislative system. Thus both, the new questions raised by the new piece of legislation and the old questions left without satisfactory answers call for new solutions. So particularly at a time, when the national application of the Directive is beginning to have an impact on border-crossing patients it is imperative to revisit patient mobility. However, in contrast to the existing literature, Free Movement of Patients in the EU tests the current legal landscape from the perspective of border-crossing patients. How, in a multi-player arena of patients, healthcare providers, healthcare funds, national governments, Union institutions, etc. with colliding ideologies can the legal situation be improved in a way that better serves patients' interests while respecting the responsibilities of the Member States in this field and with the legal tools currently available? This book is of interest to scholars and practising experts dealing with patient mobility or social security issues as well as stakeholders and decision-makers. Dr Gabriella Berki is an assistant professor at the University of Szeged and guest lecturer at the Sorbonne University (Paris, France) and the University of Rijeka (Croatia). She is also a member of two European expert networks funded by the European Commission, FMSSFE Statistics and FreSsco, both active in the fields of social security coordination and the free movement of workers.
