This newest volume in the History of Medieval Canon Law series surveys the history of Byzantine and Eastern canon law. Beginning in the Patristic Age, Susan Wessel outlines the evolution of ecclesiastical law before the Council of Nicaea (325 A.D.). She covers the earliest documents and councils in the Christian tradition, and concludes that the councils replaced other sources of authority as bishops moved to a more democratic model of church organization. Heinz Ohme then offers a detailed analysis of the Greek councils and the writings of the Greek Fathers. He treats the sources of canonical material of Byzantine canon law down to the Quinisext Council (Trullanum, 692). Spyros Troianos presents a comprehensive survey of the Greek canonical collections and their compilers from the fourth to the eleventh century. In extending his coverage to 1500, Troianos provides bibliographical and biographical information about the most important Byzantine canonists who remain virtually unknown in English language literature: John Zonaras, Alexios Aristenos, and the Byzantine Gratian, Theodore Balsamon. With Hubert Kaufhold's contribution, the book also explores the wide range and variety of law in Eastern Christian communities, including Western Syrians (Jacobites), the Copts, Ethiopians, Armenians, Georgians, Nestorians, and Maronites.

Byzantine church law remains terra incognita to most scholars in the western academy. In this work, David Wagschal provides a fresh examination of this neglected but fascinating world. Confronting the traditional narratives of decline and primitivism that have long discouraged study of the subject, Wagschal argues that a close reading of the central monuments of Byzantine canon law c. 381-883 reveals a much more sophisticated and coherent legal culture than is generally assumed. Engaging in innovative examinations of the physical shape and growth of the canonical corpus, the content of the canonical prologues, the discursive strategies of the canons, and the nature of the earliest forays into systematization, Wagschal invites his readers to reassess their own legal-cultural assumptions as he advances an innovative methodology for understanding this ancient law. Law and Legality in the Greek East explores topics such as compilation, jurisprudence, professionalization, definitions of law, the language of the canons, and the relationship between the civil and ecclesiastical laws. It challenges conventional assumptions about Byzantine law while suggesting many new avenues of research in both late antique and early medieval law, secular and ecclesiastical.

Die Vollendung des 65. Lebensjahres nehmen Kollegen und Schüler zum Anlass, den Professor für Kirchenrecht an der Universität Innsbruck, Wilhelm Rees, mit einer Festschrift zu ehren und sein wissenschaftliches Wirken im Bereich des Kanonischen Rechts zu würdigen. Die Festschrift trägt den Titel »Rechtskultur und Rechtspflege in der Kirche«. Sie soll auf diese Weise zentrale Anliegen widerspiegeln, denen sich Wilhelm Rees in seiner wissenschaftlichen Arbeit und in der Mitwirkung am Leben der Kirche in hohem Maße verpflichtet sieht. Bei der kritischen Analyse der kirchlichen Ordnung und der kommentierenden Begleitung der kirchlichen Gesetzgebung tritt er immer wieder dafür ein, dem Ideal der Gerechtigkeit gemäße Lösungen zur Geltung zu bringen. Auch für die praktische Arbeit eines Kirchenrechtlers ist Rees sich nicht zu schade und leistet als Berater und Beistand rechtssuchenden Menschen seine kundige Unterstützung. In his critical analysis of the eccelsiastical legal order and in his comments and observations on ecclesiastical legislation he keeps advocating the implementation of solutions that are in accordance with the ideal of justice. The contributions assembled in this volume offer a critical engagement with Rees's work in central areas of common law, such as constitutional law, criminal and procedural law as well as comparative religious law.
