La protection des secrets d'affaires revêt un grand intérêt pour les entreprises françaises et européennes et entretient des liens étroits avec le droit de la propriété intellectuelle. Le secret peut ainsi représenter une alternative à la protection conférée par le droit des brevets lorsque le choix stratégique de ne pas procéder à la divulgation de l'invention est effectué. De plus, il offre une protection de fait à des éléments insusceptibles de répondre aux conditions posées par le Code de la propriété intellectuelle pour la reconnaissance de droits privatifs. Est-il opportun de renforcer la position des détenteurs de secrets d'affaires en sanctionnant l'appréhension non autorisée ou le détournement de ces derniers ? L'Union européenne l'a pensé en adoptant récemment la Directive 2016/943 sur la protection des savoir-faire et des informations commerciales non divulgués (secrets d'affaires). Plus d'une année après l'adoption de ce texte, la longue mécanique des travaux préparatoires semble désormais enclenchée en vue de sa transposition au sein des différents Etats membres. La France n'échappe pas à ce mouvement, et on peut s'attendre à voir ressurgir prochainement les oppositions et les débats qui accompagnent, avec constance, les travaux législatifs afférents à cette catégorie, bien particulière, de secrets. Les questions soulevées sont nombreuses et interpellent aussi bien le juriste d'entreprise que l'avocat, le journaliste, le lanceur d'alerte ou encore le salarié tenté de mettre au service de son nouvel employeur tout le savoir-faire acquis à l'occasion de ses précédentes fonctions. Quelle est la nature de ces secrets d'affaires ? Comment la définir ? A quelle conciliation parvenir avec les détenteurs de droits fondamentaux potentiellement affectés par leur protection ? Quels sont les apports de la directive et comment entend-elle préserver la confidentialité des secrets en cours de procès ? Quels sont les oubliés de l'harmonisation et risquent-ils de s'inviter au stade de la transposition ? Telles sont les questions, parmi d'autres, que le présent ouvrage s'attache à traiter, avec l'ambition assumée de nourrir le débat sur les contours d'une protection équilibrée des secrets d'affaires.

This 2005 book provides an analytic overview and assessment of the changing nature of crime in the burgeoning information society. Bringing together views from leading national and international authorities, Hedieh Nasheri explains the historical and theoretical background surrounding issues of economic espionage, trade secret theft and industrial spying and its impact on society.
