Abstract

As the first comprehensive study of Buddhism and law in Asia, this interdisciplinary volume challenges the concept of Buddhism as an apolitical religion without implications for law. Buddhism and Law draws on the expertise of the foremost scholars in Buddhist studies and in law to trace the legal aspects of the religion from the time of the Buddha to the present. In some cases, Buddhism provided the crucial architecture for legal ideologies and secular law codes, while in other cases it had to contend with a pre-existing legal system, to which it added a new layer of complexity. The wide-ranging studies in this book reveal a diversity of relationships between Buddhist monastic codes and secular legal systems in terms of substantive rules, factoring, and ritual practices. This volume will be an essential resource for all students and teachers in Buddhist studies, law and religion, and comparative law.

Abstract

What happens to Buddhist monks and nuns who commit crimes? Buddhism in Court is the first book to uncover a long-overlooked Buddhist campaign for clerical legal privileges that aim to exempt monks and nuns from being tried and punished in the courtroom. It unveils this campaign's origins in Indian Buddhism and how Chinese Buddhists' engagement with it reshaped Buddhism's place in the jurisdictional landscape in China from the fourth century to the present. In Asia, the jurisdictional boundary between Buddhism and the state was never fixed. Buddhism in Court is the first study to examine the unique contribution of Chinese Buddhists in negotiating that boundary by creating what Cuilan Liu describes as "hybrid courts" and "hybrid laws" in the fourth century to deal exclusively with religious legal matters. Drawing on various pre-modern and contemporary primary sources in Chinese, Buddhism in Court traces the legacy of the campaign for clerical legal privileges from its origins in India to its transformation in China and its continuing impact in the Chinese courtroom to the present day. Diverting from the dynasty-centered approach to studying religion, law, and history in China, Buddhism in Court expands our understanding of this legacy of early Chinese Buddhism and challenges the notion that the passage between imperial and post-imperial China was one of disruption.

It is widely assumed that a well-designed and well-implemented constitution can help ensure religious harmony in modern states. Yet how correct is this assumption? Contrairement au préjugé occidental d'un culte asocial pour ne pas dire libertaire, le bouddhisme dans ses différentes écoles fut en réalité fortement impliqué dans la vie sociale et politique des régions qu'il a traversées. Un autre cliché est de ne voir dans cette religion qu'une spiritualité, presque une hygiène de vie, faite de méditation dénuée de règles morales et juridiques. Cet ouvrage entend se dégager de telles idées reçues en présentant les sources des normes bouddhiques, celles qui régissent la communauté monacale bien sûr, mais aussi celles qui s'adressent aux laïcs, relatives à la famille, à la sexualité, au comportement personnel, au travail, à la propriété, au commerce, aux relations entre religion et politique. Il entend montrer que du Tibet au Japon en passant par la Chine, les écoles bouddhistes se sont inscrites dans des contextes culturels qu'elles ont influencés mais qui ont aussi été influencés par elles. Ces interactions entre religion et cultures se reflètent dans le miroir des normes, jusqu'à la rencontre avec la modernité occidentale, cause pour certains d'une déformation si ce n'est d'une dénaturation du message bouddhique originel. Mais l'origine n'est-elle pas toujours mythique ? Ceux qui cherchent à réhabiliter une tradition ne tombent-ils pas, sans le savoir, dans le travers qu'ils voudraient éviter : la reconstruction de normes qui leur paraissent plus adéquates, autrement dit mieux adaptées à leur situation actuelle ? Les auteurs ont tenté de faire reposer ces questions sur des recherches historiques, juridiques et sociologiques.
