The concept of democratic legitimization is used in various disciplines and also in different legal contexts. However, it is regularly not a matter of one and the same legal standard; rather, German constitutional law and EU primary law appear to contain very different approaches. There are also certain shifts in discourse between jurisprudence and legal scholarship. The thesis differentiates methodologically and disciplinarily in order to put the different positions in relation to each other and to gain a better overview of the discourse. Der Begriff der demokratischen Legitimation wird in verschiedenen Fachdisziplinen und auch in verschiedenen rechtlichen Kontexten verwendet. Dabei handelt es sich allerdings regelmäßig nicht um ein und denselben rechtlichen Maßstab, vielmehr zeigen das deutsche Verfassungsrecht und das Primärrecht der EU teilweise sehr unterschiedliche Ansätze. Auch zwischen Rechtsprechung und der Rechtswissenschaft zeigen sich gewisse Diskursverschiebungen. Die Arbeit nimmt eine methodische und disziplinäre Differenzierung vor, um die unterschiedlichen Positionen zueinander ins Verhältnis zu setzen und einen besseren Überblick über den Diskurs zu gewinnen.

Courts with the right to constitutional review exert considerable power in a political system. However, especially for Kelsenian constitutional courts there are hardly any large-N studies. This is mainly due to a lack of data. For the German Federal Constitutional Court, this gap has been closed by building a novel database, the development of which is depicted in this book. Employing data from this database, the occurrence of separate opinions in general and their different types in particular are analyzed. The book introduces a new, universal theory that reconciles and expands existing explanations. In a second step, the theory is applied to the German Federal Constitutional Court. It can be proven that one factor that has been neglected so far plays a decisive role: The judges' behavior depends on the profession they pursue after their time in office. Moreover, the study shows that -- contrary to the common literature -- it is not mainly the topic that determines a case's conflict potential but rather the number of issues a decision has to address.

In Germany, legislation concerning the treatment of prisoners and detainees in forensic psychiatric institutions, as well as the interpretation of the relevant law have to a large extent been shaped by the case-law of the Federal Constitutional Court. The author, from 2002 to 2014 Associate Justice on the Federal Constitutional Court, presents a comprehensive survey of that case-law on the basis of extracts from decisions, covering general principles – concerning, for example, security, resocialisation, the implementation of preventive detention, and the admissible reach of privatisations – as well as all kinds of living conditions and measures to which prisoners and other detainees may or may not be subjected, and the relevant constitional requirements concerning judicial protection.
