Abstract

The Burr treason trial, one of the greatest criminal trials in American history, was significant for several reasons. The legal proceedings lasted seven months and featured some of the nation's best lawyers. It also pitted President Thomas Jefferson (who declared Burr guilty without the benefit of a trial and who masterminded the prosecution), Chief Justice John Marshall (who sat as a trial judge in the federal circuit court in Richmond) and former Vice President Aaron Burr (who was accused of planning to separate the western states from the Union) against each other. At issue, in addition to the life of Aaron Burr, were the rights of criminal defendants, the constitutional definition of treason and the meaning of separation of powers in the Constitution. Capturing the sheer drama of the long trial, Kent Newmyer's book sheds new light on the chaotic process by which lawyers, judges and politicians fashioned law for the new nation.

During the period, Jefferson receives twice as many documents as he writes. He sits for portraits by Charles Févret de Saint-Mémin and Rembrandt Peale. The nation endures an extreme winter. William Dunbar begins to send information from the exploration of the Ouachita River. Acts of Congress create new territories and give Orleans Territory an assembly and a path to statehood. The Senate ratifies a treaty to acquire an estimated 50 million acres of land from the Sac and Fox tribes. Levi Lincoln resigns, Robert Smith asks to succeed him as attorney general, and Jefferson seeks a new secretary of the navy. Jefferson and vice-presidential candidate George Clinton receive 162 electoral ballots against 14 for their opponents, Charles Cotesworth Pinckney and Rufus King. Abstract

"Whatever sense of hope the Founder Fathers may have felt at the new government's birth, almost none of them carried that optimism to their graves. Franklin survived to see the Constitution in action for only a single year, but most of the founders who lived into the nineteenth century came to feel deep anxiety, disappointment, and even despair about the government and the nation that they had helped to create. Indeed, by the end of their lives many of the founders judged the Constitution that we now venerate to be an utter failure that was unlikely to last beyond their own generation. This book tells the story of their disillusionment. The book focuses principally on four of the preeminent figures of the period (1787): George Washington, Alexander Hamilton, John Adams, and Thomas Jefferson. These four lost their faith in the American experiment at different times and for different reasons, and each has his own unique story. As Rasmussen shows in a series of three chapters on each figure, Washington became disillusioned above all because of the rise of parties and partisanship, Hamilton because he felt that the federal government was not sufficiently vigorous or energetic, Adams because he believed that the American people lacked the requisite civic virtue for republican government, and Jefferson because of sectional divisions brought on (as he saw it) by Northern attempts to restrict slavery and consolidate power in the federal government. Washington, Hamilton, Adams, and Jefferson were the most prominent of the founders who grew disappointed in what America became, but they were certainly not the only ones. In a final chapter Rasmussen shows that most of the other leading founders-including figures such as Samuel Adams, John Jay, James Monroe, and Thomas Paine-fell in the same camp. The most notable founder who did not come to despair for his country was the one who outlived them all, James Madison. Madison did harbor some real worries but a final chapter also explores why Madison largely kept the republican faith when so many of his compatriots did not"--

"In 63 BC the corrupt aristocrat Lucius Sergius Catilina (Catiline in English) aimed to topple the Roman Republic. Catiline attracted a wide array of supporters: debt-ridden men and women from prominent families, youths looking for adventure, the less well-off tried of a political class that seemed only to look out for its own interests. Frustrated in his efforts to be elected consul, Catiline fled Rome while several of his associates stayed behind with secret plans to torch the city and murder its leading politicians. The story of Catiline and his conspiracy is recounted by the Roman historian Sallust in his short book, The War with Catiline Sallust's account culminates with the unmasking of these urban conspirators at a meeting of the Senate, followed by a stormy debate that led to their execution, and then the ultimate defeat of Catiline and his legions in battle. While Catiline is at the heart of the story, some of the most important figures of Roman history play key roles in the story: Cicero, the ambitious young senator who calculated how best to protect Rome; Julius Caesar, who delivers a memorable speech defending the conspirators against execution; and Cato, an ardent defender of the Republic. Catiline himself is a fascinating figure - a bitter and haunted man, determined to destroy Rome, yet sympathetic to the plight of struggling Romans. This book offers a new translation of Sallust's account of the thwarted conspiracy framed for a contemporary audience. As the translator Josiah Osgood notes in his introduction, Sallust's work is not limited to just recounting the conspiracy but engages with broader questions, still relevant today, about how republics flourish and how they break down. Abstract

This volume's 598 documents span 22 April 1818 to 31 January 1819. Jefferson spends months preparing for a meeting to choose the site of the state university. He drafts the Rockfish Gap Report recommending the location of the University of Virginia at Charlottesville as well as legislation confirming this decision. Jefferson travels to Warm Springs to cure his rheumatism but instead contracts a painful infection on his buttocks. His enforced absence from Poplar Forest leads to detailed correspondence with plantation manager Joel Yancey. A work that Jefferson helped translate, Destutt de Tracy's Treatise on Political Economy, is finally published. Salma Hale visits Monticello and describes Jefferson's views on food, wine, and religion. In acknowledging an oration by Mordecai M. Noah, Jefferson remarks that the suffering of members of the Jewish faith "has furnished a remarkable proof of the universal spirit of religious intolerance." He receives long discussions of occult science and the nature of light by Robert Miller and Gabriel Crane. Abigail Adams dies, and Jefferson assures John Adams that their own demise will result in "an ecstatic meeting with the friends we have loved & lost and whom we shall still love and never lose again."

A multifaceted portrait of the early American republic as seen through the lens of the Burr ConspiracyIn 1805 and 1806, Aaron Burr, former vice president of the newly formed American republic, traveled through the Trans-Appalachian West gathering support for a mysterious enterprise, for which he was arrested and tried for treason in 1807. This book explores the political and cultural forces that shaped how Americans made sense of the uncertain rumors and reports about Burr's intentions and movements, and examines what the resulting crisis reveals about their anxieties concerning the new nation's fragile union and uncertain republic.Burr was said to have enticed some people with plans to liberate Spanish Mexico, others with promises of land in the Orleans Territory, still others with talk of building a new empire beyond the Appalachian Mountains. The Burr Conspiracy was a cause célèbre of the early republic-with Burr cast as the chief villain of the Founding Fathers-even as the evidence against him was vague and conflicting. Rather than trying to discover the real intentions of Burr or his accusers-Thomas Jefferson foremost among them-James E. Lewis Jr. looks at how differing understandings of the Burr Conspiracy were shaped by everything from partisan politics and biased newspapers to notions of honor and gentility. He also traces the enduring legacy of the stories that were told and accepted during this moment of uncertainty.
