L’Accord sur les Aspects des Droits de Propriété Intellectuelle qui touchent au Commerce impose la protection internationale des brevets pharmaceutiques. Il a toutefois singulièrement verrouillé la concurrence et le mécanisme d’attribution des licences obligatoires pour les Etats africains. Ce double verrouillage tient au fait que, depuis la création de l’Organisation mondiale du commerce (OMC), dans les relations Nord-Sud, les Etats industrialisés, propriétaires de 97% des brevets d’invention, ne considèrent plus ces derniers comme des droits de propriété immatérielle, mais comme des droits de propriété matérielle indérogeables.
