"As a means of industrial organization, cartels have had mixed acceptance in Europe after the end of the Industrial Revolution. In the late Nineteenth Century there were approximately four industry-wide cartels operating in Germany. By 1923, the figure had grown to over 1,500. Such organizations were a common, legal and (often) encouraged means of facilitating industrial and national development" -- Provided by publisher.

"This book is the first detailed treatment of the approaches taken to enforce competition laws against cross-border cartels (CBCs) from the perspective of young and small competition authorities (more than 70% of the total number of authorities worldwide). No other legal or inter-disciplinary scholarship exists in the market that deals with the issue of a taxonomy of CBCs combined with young/small competition authorities' problems. The book looks at the extent of the harms caused by CBCs and issues associated with tackling them at a transnational level. It explains why past solutions to problems with cooperation have failed and proposes novel ideas on how to improve cooperation and coordination in certain types of CBC investigations (transnational and regional CBCs). The proposals are based on primary-source information and observations made by the author as part of his work in the UN, and interviews with leading enforcers from young, small, old and large jurisdictions. Young/small competition authorities, competition lawyers and economists, scholars and students within the fields of competition law and international law, and those interested in international cooperation and coordination in the area of cartel enforcement in emerging markets will greatly benefit from this book. It is clearly structured and extensively referenced, providing a valuable guide to the topic"--

"The law against hard core cartel activity involving conspiracies such as price fixing, bid rigging and market sharing agreements between competitors is widely regarded as the centrepiece of competition law. It is a priority for both EU and UK competition authorities. The Law of Cartels is an authoritative practitioner work offering practical advice for both lawyers advising companies and for company directors. In addition to a comprehensive overview of the main aspects of the law, it offers guidance on dealing with cartel investigations by the competition authorities, implementing compliance programmes to reduce the risk of cartel activity taking place, and examines the options for companies accused of hard-core cartel activity"--Provided by publisher.

This study of the normative justification for the use of criminal sanctions as a means of cartel control goes beyond the historical and economic viewpoints by adding a normative evaluation of anti-cartel regimes and analysing cartel control in the USA, Europe and the UK. The analysis is unique in seeking to establish why, in a liberal society, criminal sanctions should apply to individuals who participate in this sort of activity. Although cartels have been rhetorically likened to theft and fraud, there are significant differences. Notwithstanding these differences, Cartels, Markets and Crime presents an argument for the criminalisation of economic collusion and, with this argument in mind, analyses the regimes of the USA, EU and UK and considers the possibility of global convergence.
