In een complexe economie als de Nederlandse, waarin talloze transacties plaatsvinden, komen heel weinig conflicten terecht in het juridisch systeem en nog veel minder voor de rechter. Er is meestal geen tijd en aandacht om de vele problemen en conflicten in een juridische strijd ‘uit te vechten'. Tegelijk is de heersende opvatting dat recht en rechtspraak de markteconomie mogelijk maken en richting geven aan het gedrag van de actoren in de samenleving. In zijn inaugurele rede bij de aanvaarding van het ambt van hoogleraar empirische analyse van rechtssystemen verkent Frans van Dijk deze schijnbare tegenstelling. Aan de hand van divers onderzoek en data over de rechtspraak maakt hij aannemelijk dat een groot deel van de – in financiële zin – grote conflicten voor de rechter komen en dat dit op alle rechtsgebieden gebeurt. Zo kan er toch grote invloed van het juridisch systeem zijn. De oplossing van conflicten verloopt vooral in reguliere productie- en distributieprocessen in onderling overleg en zonder juridisering. Dat ligt anders bij de inrichting van nieuwe processen en ketens met de bijbehorende investeringen.
