Mit der zunehmenden Ausweitung und Verdichtung des europäischen Rechtsmaterials im Bereich des Privatrechts mehren sich Vorschriften, die im Interesse der Zukunftsoffenheit und Anpassungsfähigkeit relativ vage und wertungsoffen sind. Insoweit stellt sich vor dem Hintergrund der gemeinschaftsrechtlichen Kompetenzordnung die Frage, ob und unter welchen Voraussetzungen eine solche Regelungstechnik das Angleichungsziel überhaupt erreichen kann und welcher Ebene innerhalb des Mehrebenensystems der Gemeinschaft die Aufgabe der Konkretisierung zukommen soll. Noch dringender und von viel grundsätzlicherer Bedeutung ist freilich die Bestimmung derjenigen Methoden und Kriterien, die die Konkretisierungsentscheidungen zum Europäischen Privatrechts im Einzelfall rational begründbar, diskutierbar und vorallem konsensfähig machen können. Dabei kann es nicht um eine beschreibende Darstellung des hergebrachten, rein formalen, Methodenkanons gehen. Anzusetzen ist vielmehr bei den der europäischen Wirtschaftsverfassung und dem Sekundärrecht zugrundeliegenden Prinzipien und Werten.
