Abstract

The book contains a collection of high-quality academic and expert contributions dealing with the central question of whether the Lisbon Treaty needs further revision. Due to the difficulties European Union actors have encountered in implementing the Lisbon Treaty’s reform and the inadequacies of the current legal framework brought to light by post-Lisbon practice, the volume focuses on possible innovations and functional approaches to improve the Union’s response to the challenges confronting it. In doing so, the volume first takes a horizontal approach to the Treaty’ revision and considers some constitutional features showing the interaction between the EU and its Member States (namely, the parameters of constitutional developments, the allocation of competences, the principles of solidarity and loyal cooperation). Then, the focus shifts to the question of fundamental rights within the EU’s constitutional framework, one of the most relevant innovations of the Lisbon Treaty being the incorporation of the Charter of Fundamental Rights into the Union’s primary law. The last part of the volume is devoted to another domain significantly reshaped by the Lisbon reform, namely, the Union’s external dimension. ECJ Advocate General Paolo Mengozzi’s conclusions highlight the common themes emerging from the various contributions, stressing the need for a more general supranational approach to the political crisis the Union is going through. Abstract

Démocratie et transparence étaient deux thèmes centraux de la déclaration de Laeken ; la cohérence de l’action de l’Union, tout particulièrement dans le domaine des relations extérieures, s’est quant à elle imposée comme un enjeu crucial dans les travaux de la Convention sur l’avenir de l’Union. Il n’est donc pas étonnant de les retrouver parmi les principes considérés comme innovateurs du traité établissant une Constitution pour l’Europe. Certes, il est acquis maintenant, avec la signature du traité de Lisbonne, que la révision des traités européens a perdu son caractère constitutionnel. Mais il n’en demeure pas moins intéressant de vérifier si les principes de la transparence, de la démocratie et de la cohérence, interprétés comme des principes constitutionnels, se perpétuant au-delà de l’échec de l’adoption d’une Constitution formelle pour l’Europe, sont respectés par l’Union européenne en voie de rénovation. L’Union européenne évolue-t-elle vers plus de transparence et de démocratie ? Telle a été la question à laquelle la première partie de cet ouvrage a tenté de répondre. Au fil des différentes contributions, se dessine une réponse nuancée : progrès incontestable du côté de la démocratisation de l’Union, bilan nettement mitigé en ce qui concerne la transparence et la simplification, surtout dans le traité de Lisbonne. La cohérence de l’action extérieure de l’Union est au centre de la deuxième partie de l’ouvrage et analysée dans ses multiples dimensions : cohérence institutionnelle d’abord, dans sa dimension verticale – entre l’Union et les Etats – et horizontale – entre les institutions de l’Union ; cohérence substantielle ensuite, entre les différentes politiques européennes ayant une dimension externe et entre l’action extérieure de l’Union et ses politiques internes. Les diverses contributions convergent vers un constat similaire : même si le traité de Lisbonne reste en retrait par rapport à la Constitution, plusieurs réformes devraient permettre à l’Union d’avancer en direction de cet objectif : personnalité juridique unique de l’Union, définition de principes et objectifs qui doivent guider l’action de l’Union sur la scène internationale dans tous ses aspects, création de la fonction de ministre des Affaires étrangères de l’Union devenu haut représentant de l’Union pour les affaires étrangères et la politique de sécurité. Le présent ouvrage, édité par Marianne Dony, directeur de l’Institut d’études européennes de l’Université libre de Bruxelles, et Lucia Serena Rossi, professeur à l’Université de Bologne, est le résultat d’une recherche internationale financée par la Commission européenne – Action Jean Monnet et menée par l’Université de Bologne, l’Université libre de Bruxelles et l’Université de Nice-Sophia Antipolis sous la coordination du professeur Lucia Serena Rossi.

Abstract

This book provides a comprehensive and updated legal analysis of the equality principle in EU law. To this end, it argues for a broad definition of the principle, which includes not only its inter-individual dimension, but also the equality of the Member States before the EU Treaties. The book presents a collection of high-quality academic and expert contributions, which, in light of the most recent developments in implementing the post-Lisbon legal framework, reflect the current interpretation of the equality principle, examining its performance in practice with a view to suggesting possible solutions in order to overcome recurring problems. To this end the volume is divided into three Parts, the first of which addresses a peculiar aspect of the EU equality that is mostly overlooked in the investigations devoted to this topic, namely, equality among States. Part II shifts to the inter-individual dimension of equality and explores some major developments contributing to (re)shaping the global framework of EU anti-discrimination law, while Part III undertakes a more practical investigation devoted to the substantive strands of that area of EU law.
