Pour satisfaire une demande pressante de flexibilité, le CDI ou contrat de travail « standard » à temps plein et à durée indéterminée a laissé place à une multiplicité de contrats « atypiques ». La fragmentation des situations et la complexité toujours accrue qui en résultent, souvent décrites comme un problème de « segmentation du marché du travail », sont source d'inégalités et entraînent la disparition des protections attachées aux contrats standard.Ce malaise n'est pas une exception française. La flexibilité des relations de travail s'est inscrite dans les contrats du travail de bien des systèmes juridiques : contrats aidés, contrats d'apprentissage, contrats de stage, contrats occasionnels y côtoient, parmi les plus atypiques, les contrats « zéro heure », les « minijobs » et, parmi les plus récentes inventions, le contrat de salarié-actionnaire.En proposant une comparaison internationale du droit des contrats de travail flexibles, cet ouvrage révèle leur incidence sur les droits individuels et collectifs des travailleurs et montre comment, à travers le monde, les différents systèmes juridiques s'efforcent, avec plus ou moins de vigueur, de concilier flexibilité et droits des salariés.

Analysing the impact of the principle on the European labour migration policy, the report presents a brief history of the notion, and discusses how it is referred to in EU labour migration policy documents. It also examines the challenges that the principle is facing as the EU immigration policy develops, tending to give increasing rights to third-country nationals.
