La maltraitance a longtemps été ignorée au cours de l'histoire, du fait de la place que l'enfant occupait dans la famille et dans la société : être inachevé, adulte en miniature soumis à l'autorité paternelle entière et totale, mais aussi être fragile et victime de nombreuses maladies infantiles souvent mortelles. Ambroise Tardieu, médecin légiste français, fut le premier à s'intéresser aux enfants maltraités et publia en 1860 un article intitulé « Étude médico-légale sur les sévices et mauvais traitements exercés sur des enfants ». Il faudra pourtant attendre encore plus de 100 ans pour que la notion d'enfant maltraité soit introduite dans les textes officiels en France (loi du 10 juillet 1989), et que la protection de l'enfant prenne une envergure internationale avec l'adoption par l'Assemblée générale des Nations Unies d'une convention des droits de l'enfant (20 novembre 1989).
