Après Les procédures d'urgence devant les juges de l'administration (vol. 21), L'acte administratif à portée générale et son contrôle juridictionnel (vol. 22) et La responsabilité de la puissance publique en droit comparé (vol. 25), la présente étude comparée est le 4e ouvrage de restitution des travaux de la section « Droit de l'action publique » de la Société de législation comparée. La section est présidée par Bernard Stirn, président de la section du contentieux du Conseil d'État.Cette section rassemble des juristes de droit public d'horizons variés - membres des juridictions administratives, de l'Université et avocats - qui ont entrepris, ensemble, de réaliser des études approfondies de droit comparé sur des thèmes qui présentent un intérêt notamment au regard de l'actualité.À l'occasion de ce nouveau cycle, la section a travaillé sur le thème de la lutte contre le terrorisme et les droits fondamentaux en droit comparé. Après un rappel du contexte français, l'ouvrage présente la situation de la lutte contre le terrorisme et les droits fondamentaux en Allemagne, en Belgique, au Chili, en Espagne, aux États-Unis, en Italie et au Royaume-Uni. Les systèmes issus de la Convention européenne des droits de l'homme, de l'Union européenne et de la Convention interaméricaine des droits de l'homme font également l'objet d'études, notamment au regard de la liberté d'expression et de la liberté d'aller et venir. Le lecteur trouvera également une synthèse des travaux, le compte-rendu des échanges intervenus lors de la matinée de restitution ainsi qu'un entretien. Cette nouvelle étude est destinée à contribuer à donner au droit comparé toute la place qui doit être la sienne dans l'étude du droit administratif français et, plus largement, dans la formation d'un authentique droit administratif européen.

"In the intellectual life of a scholar, it is not infrequent for a research question to rattle around in the back of the mind for years. Then all of a sudden comes the realisation that the time is ripe to tackle the topic, and that an attempt has to be made at presenting, discussing and empirically analysed it. I will not go into the reasons why I think that this is now the right moment to address the question on the implementation of the two traditional democratic values, and their transformations over recent years, partly as a consequence of the economic crisis, and its prospective sustainability. Maybe in his Discorsi Machiavelli was only right when he recommends going back to values in times of crisis. There are, of course, other objective and subjective reasons, and the former will emerge directly and indirectly in the first chapter"--
