2014 jahrte sich die Publikation von Friedrich Carl von Savignys Schrift Vom Beruf unsrer Zeit fur Gesetzgebung und Rechtswissenschaft zum zweihundertsten Mal. Bereits Mitte des 19. Jahrhunderts liess diese Schrift auch viele Rechtsgelehrte ausserhalb Deutschlands vom beruhmten Savigny sprechen. Weit uber den Anlass der Schrift hinausgehend hatte Savigny eine bis heute andauernde Grundsatzdebatte uber den Begriff und die Entstehung des Rechts sowie die Aufgabe und das Selbstverstandnis der Rechtswissenschaft eroffnet. Gegenstand des vorliegenden Sammelbandes sind rechtshistorische Forschungsbeitrage zur globalen Rezeption von Savignys Schrift sowie rechtstheoretische Uberlegungen zur Anschlussfahigkeit von Savignys Rechtsquellenpluralismus im gegenwartigen Zeitalter staatlicher Deregulierung und Transnationalisierung des Rechts. The year 2014 marked the bicentenary of the publication of Friedrich Carl von Savigny's "Vom Beruf unsrer Zeit fur Gesetzgebung und Rechtswissenschaft". Even in the mid-19th century, many legal scholars outside of Germany spoke of the "renowned Savigny" on account of this pamphlet. Much more importantly, Savigny opened up a fundamental debate that continues today over the definition and emergence of law and the role and self-perception of jurisprudence. The present anthology comprises legal historical contributions on the global reception of Savigny's pamphlet and legal theoretical observations on the integrability of his thoughts on the pluralism of legal sources in the present age of state deregulation and the transnationalisation of law. The beginning of the 20th century marks a crucial point in legal hermeneutics: On the one hand, it concerns the ending of a long tradition of legal interpretation which had mainly focused on the creative character of legal application. On the other hand, the 20th century is a paradigmatic new beginning, since Gustav Radbruch, Arthur Kaufmann and Winfried Hassemer form a "hermeneutical opposition" against the increasingly influential analytic theory of law. The present volume, previously published in Italy assembles the most important writings with short introductions.
