This article explores the legality of streaming video content, using the pending case before the CJEU of C-527/15, Stichting Brein v Jack Frederik Wullems (Filmspeler), 5th October 2015 as a backdrop. The article considers the ‘lawful use’ of temporary copies under Art 5 of the Copyright Directive 2001 and the ‘act of communication’ under Art 3 of the same directive, both within the context of streaming infringing content. A liberal approach to both is put forward with a view of ensuring the proper functioning of the Internet and Information society. The article draws on existing and upcoming case law to highlight the problems and confusions surrounding this topic and the need for legislative change.
