Today, consent is a fundamental concept in the European legal framework on data protection. The analysis of the historical and theoretical context carried out in this book reveals that consent was not an intrinsic notion in the birth of data protection. The concept of consent was included in data protection legislation in order to enhance the role of the data subject in the data protection arena, and to allow the data subject to have more control over the collection and processing of his/her personal information. This book examines the concept of consent and its requirements in the Data Protection Directive, taking into account contemporary considerations on bioethics and medical ethics, as well as recent developments in the framework of the review of the Directive. It further studies issues of consent in electronic communications, carrying out an analysis of the consent-related provisions of the ePrivacy Directive.

"This book provides an article-by-article commentary on the Law Enforcement Directive (Directive 2016/680). The LED repealed the Council Framework Decision 2008/977/JHA and was, together with the General Data Protection Regulation, at the heart of the legal reform of the EU's data protection law. Its provisions apply to the processing of personal data for law enforcement purposes by national competent authorities and must be transposed by the Member States in their national legal systems"--

Bringing together leading European scholars, this thought-provoking Research Handbook provides a state-of-the-art overview of the scope of research and current thinking in the area of European data protection. Offering critical insights on prominent strands of research, it examines key challenges and potential solutions in the field. Chapters explore the fundamental right to personal data protection, government-to-business data sharing, data protection as performance-based regulation, privacy and marketing in data-driven business models, data protection and judicial automation, and the role of consent in an algorithmic society. Expert contributors investigate the impact of Brexit on the right to data portability, essential equivalence as a benchmark for international data transfers following Schrems II, and data protection in relation to the application and boundaries of the Law Enforcement Directive, trade secret privileges, and competition law. Comprehensive, yet accessible, the Research Handbook on EU Data Protection Law will be a valuable resource for students and scholars of technology and data protection law, privacy law and European law more broadly, while also being a useful tool for practitioners and policy makers concerned with data protection.

With a Foreword by Professor Rafael Capurro, International Centre for Information Ethics (ICIE); Distinguished Researcher in Information Ethics, School of Information Studies, University of Wisconsin-Milwaukee, USA Considered by many to be science fiction, information and communication technology (ICT) has been implanted into the human body for years. Medical human ICT implants such as cochlear implants are in common use, forming intimate links between technology and body. Such restorative devices are increasingly advanced, with some directly interacting with the brain and others near outperforming their natural counterpart. Recently, low-tech human ICT implants have been increasingly employed in non-therapeutic contexts. Applications include VIP nightclub entry, automated payments and controlling secure access. With self-experimenters pushing boundaries and medical technology drift to non-medical application, this is clearly just the beginning. Opportunities for human enhancement through ICT implants have become very real. Despite stakeholders calling for greater legal certainty, gaps have already emerged between the commercial reality of human ICT implants and the legal frameworks used to regulate them. It is not surprising that increasing commercialisation and growing potential has generated debate over the ethical, legal and social aspects of the technology, its products and application. And its trajectory. The contributors to this book, all leaders in their respective fields, not only focus on the latest technological developments, but also the legal, social and ethical implications of the use and further application of these technologies. .

The book in front of you is the first international academic volume on the legal, philosophical and economic aspects of the rise of 3D printing. In recent years 3D printing has become a hot topic. Some claim that it will revolutionize production and mass consumption, enabling consumers to print anything from clothing, automobile parts and guns to various foods, medication and spare parts for their home appliances. This may significantly reduce our environmental footprint, but also offers potential for innovation and creativity. At the same time 3D printing raises social, ethical, regulatory and legal questions. If individuals can print anything they want, how does this affect existing systems of intellectual property rights? What are the societal consequences of the various types of products one can print with a 3D printer, for example weapons? Should all aspects of 3D printing be regulated, and if so, how and to what ends? How will businesses (have to) change their way of working and their revenue model in light of the shift to printing-on-demand? How will the role of product designers change in a world where everyone has the potential to design their own products? These and other questions are addressed in high quality and in-depth contributions by academics and experts, bringing together a wide variety of academic discussions on 3D printing from different disciplines as well as presenting new views, broadening the discussion beyond the merely technical dimension of 3D printing.Bibi van den Berg is Associate Professor at eLaw, the Center for Law and Digital Technologies at Leiden University, The Netherlands. Simone van der Hof is Full Professor at eLaw in Leiden and Eleni Kosta is Associate Professor at TILT, the Tilburg Institute for Law, Technology and Society at Tilburg University, The Netherlands.

This book contains selected papers presented at the 12th IFIP WG 9.2, 9.5, 9.6/11.7, 11.6/SIG 9.2.2 International Summer School on Privacy and Identity Management, held in Ispra, Italy, in September 2017. The 12 revised full papers, 5 invited papers and 4 workshop papers included in this volume were carefully selected from a total of 48 submissions and were subject to a three-phase review process. The papers combine interdisciplinary approaches to bring together a host of perspectives: technical, legal, regulatory, socio-economic, social, societal, political, ethical, anthropological, philosophical, and psychological. They are organized in the following topical sections: privacy engineering; privacy in the era of the smart revolution; improving privacy and security in the era of smart environments; safeguarding personal data and mitigating risks; assistive robots; and mobility and privacy.
