This book presents an analysis of global legal history in Modern times, questioning the effect of political revolutions since the 17th century on the legal field. Readers will discover a non-linear approach to legal history as this work investigates the ways in which law is created. These chapters look at factors in legal revolution such as the role of agents, the policy of applying and publicising legal norms, codification and the orientations of legal writing, and there is a focus on the publicization of law. The author uses Herbert Hart’s schemes to conceive law as a human artefact or convention, being the union between primary rules of obligations and secondary rules conferring powers. Here we learn about those secondary rules and the legal construction of the Modern state, and we question the extent to which codification and law reporting were likely to revolutionize the legal field. These chapters examine the hypothesis of a legal revolution that could have concerned many countries in modern times. To begin with, the book considers the legal aspect of the construction of Modern States in the 17th and 18th centuries. It goes on to examine the consequences of the codification movement as a legal revolution before looking at the so-called “constitutional” revolution, linked with the extension of judicial review in many countries after World War II. Finally, the book enquires into the construction of an EU legal order and international law. In each of these chapters, the author measures the scope of the change, how the secondary rules are concerned, the role of the professional lawyers and what are the characters of the new configuration of the legal field. This book provokes new debates in legal philosophy about the rule of change and will be of particular interest to researchers in the fields of law, theories of law, legal history, philosophy of law and historians more broadly.

L’histoire du droit privé depuis 1804 se doit d'abord d’être une histoire «externe» s’attachant aux sources (au sens large) de ce droit : la législation civile, la jurisprudence, la doctrine et la pratique. Mais il convient également d’envisager une histoire «interne» proposant un essai d’histoire globale du système juridique issu de la codification napoléonienne. Ce manuel sert de préliminaire à cette démarche et invite à une réflexion sur l’autonomie du droit par rapport à la société.

Les juristes considèrent souvent que toute société a un droit. Une conception positiviste du droit comme artefact humain conduit, au contraire, à envisager que la technologie juridique a été inventée dans l'histoire pour formaliser les changements normatifs. Cette technologie du changement a pu être ensuite transférée, par la force ou le prestige, dans d'autres sociétés. Les transferts de droit ne sont-ils pas à l'origine de plusieurs mondialisations dont on pourrait dessiner les profils ?Un premier profil, de caractère historique, montre que le droit romain, le droit chinois et le droit musulman ont donné lieu dans les siècles passés à de grandes vagues d'expansion. Avec l'impérialisme colonial, l'Occident a imposé ses conceptions du droit, en diffusant des modèles de constitution ou de codification, ainsi que des règles du common law. Depuis 1945, l'hégémonie américaine n'est pas sans liens avec les nouvelles formes, en apparence plus achevées, de mondialisation du droit.Un second profil propose une typologie des ordres juridiques actuels en relativisant la cartographie traditionnelle des familles du droit pour privilégier des domaines où les changements ont été plus notables au cours de ces dernières décennies : les diverses configurations des ordres juridiques démocratiques, le maintien ou non des statuts personnels, l'opposition entre traditions privatistes et commercialisation du droit, les flux ou reflux de l'ordre public social.

En France et dans de nombreux pays européens, les avocats et les notaires sont regroupés en ordres et en chambres. Peut-on parler d'une survivance de l'Ancien Régime pour cette organisation de type corporatif ? Les gardiens de la tradition, comme ses adversaires les plus déterminés allèguent volontiers la grande ancienneté de ces structures pour les défendre ou les condamner. Une démarche historique et comparatiste amène à nuancer cette image figée des " corporations " de juristes. Ordres et chambres, loin d'être des vestiges de l'organisation des métiers du Moyen Age, sont des créations relativement récentes liées aux transformations du droit et à l'essor de l'Etat depuis le XVIIe siècle. Leur apparition, située à une date variable selon les pays, a donné lieu à des débats sur la conception même des professions judiciaires et juridiques. Leur rôle dans le processus de régulation des pratiques professionnelles a souvent été plus limité que ne l'affirmaient des dirigeants portés à exalter le sentiment d'indépendance. Naguère concurrencés par les associations et les syndicats, aujourd'hui menacés par la concentration des firmes juridiques, ordres et chambres conservent une fonction de nature à la fois symbolique et politique qu'illustrent les treize études réunies dans cet ouvrage collectif.
