Het hedendaagse vermogensrecht is ontstaan vanuit verschillende rechtstradities. De belangrijkste is die van het Romeinse recht. Dit boek geeft eerst een globaal overzicht van het Romeinse goederenrecht en verbintenissenrecht zoals te vinden in het Corpus iuris civilis van keizer Justinianus (482-565). In de Middeleeuwen vormde het Corpus iuris het uitgangspunt voor de rechtswetenschap; vanaf de vijftiende eeuw kreeg het grote invloed op het privaatrecht in geheel continentaal Europa en daarbuiten. Aan de hand van drie centrale thema's - overdracht, contract en onrechtmatige daad - volgt Fons et origo iuris vervolgens de doorwerking van het Corpus iuris vanaf de twaalfde eeuw tot de dag van vandaag.

Through recent changes in Dutch (1992) and English (1999) private law, contracts for a third-party beneficiary are, in Western Europe, nowadays considered to be effective and enforceable. This concept is, however, incompatible with both the civilian tradition on the continent and the traditional parties-only rule of English common law. The purpose of this study is to show how the problem of the third-party beneficiary was dealt with during the various periods of Western legal thought and to discuss the subject from the perspective of present-day comparative law. The book is of interest not only to legal historians, but also to all who are engaged with present-day private law – scholars, practitioners and advanced students. De Oost-Romeinse keizer Justinianus (482-565) liet in de jaren 528-534 een selectie van Romeinsrechtelijke teksten bij elkaar brengen in drie boeken: Instituten, Digesten en Codex Justinianus. Aangevuld met zijn latere wetgeving (de Novellen) werden deze boeken in 554 naar Italië gebracht en daar als geldend recht ingevoerd. Onduidelijk is of, en zo ja, hoe lang, ze daar als zodanig gefunctioneerd hebben.Vast staat echter dat deze erfenis van Justinianus, het Corpus Iuris Civilis, aan de basis staat van de latere rechtstraditie van het Romeinse recht, de belangrijkste van verschillende rechtstradities waaruit ons hedendaagse vermogensrecht is ontstaan. In de middeleeuwen vormde dit Corpus Iuris het uitgangspunt voor de rechtswetenschap; vanaf de vijftiende eeuw kreeg het grote invloed op het privaatrecht in geheel continentaal Europa en daarbuiten.De erfenis van Justinianus geeft eerst een globaal overzicht van het Romeinse goederenrecht en verbintenissenrecht zoals te vinden in het Corpus Iuris.
