Elle peut s’y retrouver lorsqu’à l’occasion d’une procédure arbitrale, la démonstration de l’existence d’une fraude – généralement commise lors de la formation ou de l’exécution d’un rapport contractuel – est rapportée par l’une ou l’autre des parties, celle-ci entendant, par la démonstration de cette fraude, se prévaloir d’un moyen d’action ou bénéficier d’une exception dans la défense qu’elle oppose à l’autre partie. Toutefois, la procédure arbitrale peut également, par elle-même, constituer le terreau d’une fraude commise par les parties ou par un tiers, voire même par les arbitres.
