Fernando Castillo de la Torre and Eric Gippini Fournier, two of the most experienced competition litigators at the European Commission, undertake an in-depth analysis of the case law of the EU Courts on the rules of evidence, proof and judicial review, as they are applied in EU competition law. These topics often engage with fundamental rights, and the book takes stock of the most frequent criticisms that are made of the EU enforcement system and review by EU Courts. The result is an extremely thorough and well-structured review of the relevant rules of law and of the precedents. The authors combine valuable insights and critical analysis to construct a definitive yet balanced portrayal of the state of EU competition law. Key features include:• unique insights from two of the most experienced litigators in EU competition law• the only comprehensive resource on the subject, all relevant legislation and a wealth of case law• a clear structure designed specifically for legal practitioners, with detailed tables of contents and targeted access to the relevant provisions• exhaustive examination of case law, including close theoretical analysis and detailed description of precedents with an eye to their practical application. This book will be an essential resource for all legal practitioners specialising in EU competition law. It will also appeal to lawyers involved in litigating and enforcing antitrust and competition law at the national level, in EU Member States or other jurisdictions where rules of evidence and judicial review are inspired by the EU system.

“Prof Pincetl and colleagues have compiled a valuable and insightful study on constructing the Southern California Energy Atlas, a unique and world leading resource. This book is informative, instructive, and an essential guide to those seeking to build a knowledge base upon which to take actions supporting the transition of the built environment towards becoming zero-carbon, energy efficient, and resilient.” — Ian Hamilton, Associate Professor,UCL Energy Institute,London In an era of big data and smart cities, this book is an innovative and creative contribution to our understanding of urban energy use. Societies need energy data in order to understand energy flows and plan for a more sustainable future. However, this data is often either not utilized or not available. Using California as an example, the book describes how to construct a energy data hub for sophisticated, socially-conscious research, and how it may be used to assist local governments and community based organizations to meet their sustainability goals. This methodology maps highly-detailed building energy use to understand patterns of consumption across buildings, neighborhoods, and socioeconomic divisions. The book then details the steps required to replicate this methodology elsewhere, demonstrating the importance of openly-accessible building energy data for transitioning cities to meet the climate planning goals of the twenty-first century. It also explains why actual data, not modeled or sampled data, is critical for accurate analysis and insights. Finally, it acknowledges the complex institutional context for this work and some of the obstacles the project has faced – utility reluctance, public agency oversight, funding and path dependencies. This book will be of great value to scholars across the environmental sectors - especially to those studying sustainable urban energy – as well as to practitioners and policy makers in these areas. Stephanie Pincetl is Director of the California Center for Sustainable Communities at the Institute of the Environment and Sustainability, University of California, Los Angeles, USA.She works on complex urban systems and their socio-environmental impacts with an aim to provide actionable science for a just energy transition. .

"In this thoroughly revised new edition of what quickly became the authoritative work when first published in 2017, Fernando Castillo de la Torre and Eric Gippini Fournier, two of the most experienced litigators in EU competition law, update their systematic analysis of the case law of the EU Courts on the rules of evidence, proof and judicial review, as they are applied in EU competition law. Fairness in the public enforcement of EU competition law is closely scrutinised and therefore maintaining robust rules on the presentation of evidence, and on the burden and standard of proof is paramount, so much the more in the context of digital markets. Also critical to the EU's commitment to fundamental rights is sound procedure and the right to judicial review. All of these are carefully reviewed in this book from the perspective of those who have been closest to the cases, with the result that the authors construct a definitive yet balanced portrayal of the state of EU competition law. Key Features include: Insight from two of the leading voices in the field. Thoroughly updated case law, demonstrating the current thinking on enforcement. New material on proof of each constituent element of the infringement. New material on abuse of a dominant position in the light of recent focus of case law on that area. Clear and accessible structure designed specifically for legal practitioners. This book continues to be an essential resource for competition litigators and for all practitioners specialising in EU competition law"--
