Abstract

"This volume sheds new light on modern theories of natural law through the lens of the fragmented political contexts of Italy in the eighteenth and nineteenth centuries, and the dramatic changes of the times. From the age of reforms, through revolution and the 'Risorgimento', the unification movement which ended with the creation of the unified Kingdom of Italy in 1861, we see a move from natural law and the law of nations to international law, whose teaching was introduced in Italian universities of the newly created Kingdom. The essays collected here show that natural law was not only the subject of a highly codified academic teaching, but also provided a broader conceptual and philosophical framework for the 'science of man'. Natural law was also a language in which reform programmes of education and politics were formulated and were acted upon."-- Provided by publisher.

Abstract

"The numerous editions and early translations produced throughout the eighteenth century enabled the broad dissemination of Emer de Vattel’s juridical-political work Droit des gens. This book investigates the global impact of the Droit des gens with regard to the different political realities, the historical and legal contexts as well as the attempts, mechanisms and strategies used to put these ideas into practice and establish new doctrine between the eighteenth and nineteenth centuries.The Droit des gens had an extremely diverse impact, owing to its varied reception in different political situations, historical and legal contexts, and attempts at practical and theoretical implementation. The fact that Vattel’s book was a point of reference for a considerable number of jurists and politicians further demonstrates its authority in the eighteenth and nineteenth centuries.The question naturally arises whether the continuous references to the work may be regarded as «typical citations of style», simply confined to referencing Vattel’s thought, or whether they are a clear sign of a deeper significance; one springing directly from the characteristics of the Droit des gens, with its capacity to organise and regulate the State in its domestic and international relations.The dissemination of the Droit des gens is reconstructed via a broad overview of the dynamics that actually underpinned the use of the treatise, ranging from its influence on political power in domestic and foreign affairs to its use as a guidebook for diplomats and consuls, and even its use as a teaching manual.Co-existing in Vattel’s work are several topics—the legislative, the political and the social—which are developed independently of one another, yet are part of one unified framework. The book aims to bring together a study of the first publication in 1758 of Vattel’s Droit des gens, its constant interaction with subsequent editions, translations and annotated versions carried out by jurists in the 19th century and its critical reception (both positive and negative) in relation to the more complex legislative contexts.The publishing history of the Droit des gens will be accompanied by the methodological aspect—closely bound to the need to write a global legal history—in which translation, in the broader sense of the term, plays a key role. Concepts of fashion and modernity are examined within the context of the practical and theoretical legal entanglements of the eighteenth and nineteenth centuries, thanks to the voices of distinguished jurists and politicians who made use of the Droit des gens and who translated and annotated it, thereby encouraging the assimilation—not always unadulterated—of Vattel’s thinking."

Abstract

Thanks to the specialist’s contributions with different backgrounds and trajectories, this volume attempts to encourage a few forays into the frontiers of Enlightenment assumptions. These assumptions have managed to cement in the projects raised by Western legal culture over the last three centuries. With a diachronic and transatlantic perspective, the contributors confront the dynamics where the border became a perimeter and a limit. Border conceives capable of stabilising and absorbing society’s structural tensions, only to open up or break, when the illusion of having reached the perfect building collided with the discovery of structural cracks. Hence, at this time, it rised a reflection on the foundations that had made the will and the individual the inexcusable (which does not mean exclusive) elements of the decline of the political and legal aspects of the Western culture. In the second half of the 20th century, this ‘West’ came to make man-citizen and his rights the parameters of the humanity, reaching the frontier where the reflection and praxis of power are still moving today. Gracias a las contribuciones de especialistas con diferentes formaciones y trayectorias, este volumen intenta fomentar unas cuantas incursiones en las fronteras que los supuestos de la Ilustración han conseguido cimentar en los proyectos levantados por la cultura jurídica occidental de los últimos tres siglos. Con una perspectiva diacrónica y transatlántica los autores se confrontan con las dinámicas donde la frontera se torcía en perímetro y se hacía límite, capaz de estabilizar y absorber las tensiones estructurales de la sociedad, para luego abrirse o quebrarse, cuando la ilusión de haber alcanzado el edificio perfecto chocaba con el descubrimiento de grietas estructurales. De allí que en estos momentos se reactivase una reflexión sobre los cimientos que habían puesto voluntad e individuo como elementos inexcusables (que no significa exclusivos) de la declinación de lo político y de lo jurídico de un Occidente que llega a hacer, en la segunda mitad del siglo XX, del hombre-ciudadano y de sus derechos los parámetros de la humanidad, alcanzado la frontera donde todavía hoy se está moviendo la reflexión y la praxis del poder.
