Konflikte scheinen heute gleichbedeutend mit Gewalt und Krieg. Doch Konflikte sind vielschichtig: Sie können sowohl zur Integration von Gesellschaften beitragen als auch diese zerbrechen. Die Anthropologie der Konflikte, zu der Georg Elwert weiterführende Thesen beigetragen hat, beleuchtet unterschiedliche Konfliktdynamiken und geht der Frage nach, unter welchen Bedingungen integrative, eskalative oder segregative Institutionen der Konfliktaustragung entstehen - oder wieder zerfallen. Der Band geht davon aus, dass Konfliktformen und soziale Organisation in einem wechselseitigen Zusammenhang stehen. Daher hat die Anthropologie der Konflikte deren verschiedene Formen, ihre kulturelle Codierung wie auch ihre konstitutive Rolle für sozialen Wandel zu untersuchen. This book addresses two developments in the conceptualisation of citizenship that arise from the »war on terror«, namely the re-culturalisation of membership in a polity and the re-moralisation of access to rights. In the context of the ever-increasing political problematization of migration in Europe, agencies charged with migrant administration create diverse categories of difference to distinguish between the »deserving migrant« and the illegal one: They assess the detainability or the credibility of asylum seekers, the danger posed by Islamic organizations, and make situational decisions that determine whether migration or labour law applies to individual agricultural workers. In this book, each chapter analyses how organizational interpretations of the common good shape bureaucratic practices. Together, these ethnographic analyses reveal how migration policies in different European countries take shape in administrative practice.

This collection of rich, empirically grounded case studies investigates the conditions and consequences of 'juridification' - the use of law by ordinary individuals as a form of protest against 'the state'. Starting from the actual practices of claimants, these case studies address the translation and interpretation of legal norms into local concepts, actions and practices in a way that highlights the social and cultural dynamism and multivocality of communities in their interaction with the law and legal norms. The contributors to this volume challenge the image of homogeneous and primordially norm-bound cultures that has been (unintentionally) perpetuated by some of the more prevalent treatments of law and culture. This volume highlights the heterogeneous geography of law and the ways boundaries between different legal bodies are transcended in struggles for rights. Contributions include case studies from South Africa, Malawi, Sierra Leone, Turkey, India, Papua New Guinea, Suriname, the Marshall Islands and Russia.
