Abstract

Security and law against the backdrop of technological development. Few people doubt the importance of the security of a state, its society and its organizations, institutions and individuals, as an unconditional basis for personal and societal flourishing. Equally, few people would deny being concerned by the often occurring conflicts between security and other values and fundamental freedoms and rights, such as individual autonomy or privacy for example. While the search for a balance between these public values is far from new, ICT and data-driven technologies have undoubtedly given it a new impulse. These technologies have a complicated and multifarious relationship with security. This book combines theoretical discussions of the concepts at stake and case studies following the relevant developments of ICT and data-driven technologies. Part I sets the scene by considering definitions of security. Part II questions whether and, if so, to what extent the law has been able to regulate the use of ICT and data-driven technologies as a means to maintain, protect or raise security, in search of a balance between security and other public values, such as privacy and equality. Part III investigates the regulatory means that can be leveraged by the law-maker in attempts to secure products, organizations or entities in a technological and multiactor environment. Lastly, Part IV, discusses typical international and national aspects of ICT, security and the law.

Abstract

This thesis analyzes the challenges posed to contract law by smart contracts when the latter are designed to provide an alternative technical regulation to transactions between parties. In order to better identify the general from the specific legal challenges, the thesis analyses smart contracts according to their: firstly, with regard to the phase of the contract’s lifecycle subject to automation by means of smart contracts and secondly with regard to the broader context of the transaction containing the smart contract, in casu on the basis of use cases in the sharing economy. The first section focuses on specific challenges that smart contracts pose according to the phase of the contract subject to automation in the use cases. The second section broadly discusses the coexistence between contract law and the blockchain specific form of techno-regulation to regulate transactions. Finally, the third section analyzes the context in which the transactions containing smart contracts take place. This thesis notably finds that the legal challenges posed by smart contracts to contract law differ according to the phase of the contract directly affected. More specifically, smart contracts affecting the enforcement phase of the contract appear to pose more acute legal challenges than the ones automating the performance of the contract. However, all smart contracts are vested with common features, and notably they all disrupt the lifecycle of contracts in some way. Finally, the context in which the transactions containing smart contracts take place does matter: the thesis especially identified different ways in which users may be misled as for the virtues of smart contracts.

When is an AI system 'defective'?

Abstract

The beginning of this thesis introduces the strict liability regime of the Product Liability Directive and its interpretation of the notion of defects through (rather limited) case law. The Product Liability Directive states that a product is defective when it does not provide the safety that a person is entitled to expect, taking all circumstances into account. An analysis of this notion shows that it is difficult to apply it to AI systems. Therefore, this thesis also elaborates on the United States’ strict liability law to determine if the American notion of defect can better address defectiveness in AI. Special attention is given to design defect due to its different method of defect assessment, called a risk-utility test. This approach might provide more specific and practical solutions to determine defect in AI than the Product Liability Directive. In order to demonstrate the assessment of defects in AI in practice, both approaches are applied to the use case of autonomous vehicles, which are one of the most popular technologies using AI software. At the end of this research are suggested possible alternatives to the defect assessment in Product Liability Directive, including the risk-utility test.

Abstract

This thesis explores the ability of the Database Directive’s sui generis right to increase data access and re-use in the EU. The in-depth analysis of the Database Directive’s provisions on the sui generis right shows that there are three legal means ingrained in this legal framework that are meant to facilitate data access and/or re-use: database consultation, lawful users’ rights and exceptions to the sui generis right. However, all of these means contain major shortcomings that must be addressed before the Database Directive can be considered a proper tool to facilitate data access and re-use. This research demonstrates that, in the context of today’s data-driven economy, lawful users’ rights must be expanded, whereas the (list of) exceptions to the sui generis right – modernised. Otherwise, the sui generis database protection may not be able to adequately fulfil one of its purposes, i.e., contributing to better data access and re-use environment in the EU. This thesis also analyses the review of the Database Directive’s sui generis right envisaged in the currently proposed Data Act. The analysis shows that the review, as regards its scope, is extremely narrow and insufficient in order to increase sui generis right’s capacity of facilitating data access and re-use. In addition, it highlights that the Commission’s choice to “clarify”, rather than amend, the scope of the sui generis right in the mentioned review likewise appears lacking and potentially causing further legal uncertainty. As a result, among other things, the relationship between the sui generis right and machine-generated data remains unclear, especially as the CJEU’s case law on the data creation/data obtainment dichotomy is insufficient to make decisive conclusions about whether the sui generis right applies to machine-generated data. As a matter of fact, a variety of legal scholars believe that machine-generated data could, under current law, fall within the scope of the sui generis right, potentially threatening to hamper data access and re-use in the EU. Notably, this thesis rejects the idea circulating in academic texts concerning the repeal of the sui generis right. There are political as well as legal obstacles ingrained in the process of repealing a directive, and the results of the repeal could be counter-productive, potentially causing legislative disharmony among the EU Member States. Instead, improvement and modernisation of the sui generis database protection should be sought. This way, the EU’s legislative experiment designed more than two decades ago to, among others, increase data access and re-use may be revived for a new life.

Abstract

This book is a liber amicorum of the Centre for IT & IP Law (CiTiP). It is published on the occasion of the 30th anniversary of the Centre for Intellectual Property Rights (CIR) and the Interdisciplinary Centre for Law and ICT (ICRI) to which it is since 2014 the successor. To celebrate this jubilee, it was decided to publish a book containing contributions from former and current researchers of our centre. The book will partly reflect the topics around which CiTiP, ICRI and CIR have been and are working, but it also mirrors the professional knowledge of many of our former collaborators who are presently working in industry, in public administration or in law firms. The opinions expressed only represent the views of the authors themselves and do not necessarily correspond to those of the Centre.
