The case against the criminalization of doping

Abstract

This thesis examines whether there is a justification to criminalize the use of performance-enhancing drugs (PEDs) in sport. Over the past decades, several states have passed legislation to specifically make the use of PEDs a criminal offence. Given the fact that criminal sanction is the most severe and coercive form of state regulation, there must be sufficient reason to deploy its use to regulate a given type of conduct. To this end, proponents of the criminalization of doping have proposed several arguments justifying the use of criminal law. Among the most common arguments favoring criminalization include arguments from cheating, the spirit of sport, fraud, risk to health, and protection of the integrity and image of sports. I argue in this thesis that none of these arguments provides good justification to criminalize doping. To support this main thesis, I claim that a criminal response is disproportionate, unnecessary, inappropriate and impractical. If sound, my argument implies that criminalization is unfair and potentially contributes to the crisis of ‘over-criminalization.’

Abstract

What makes a society the best that it can be? The current study addresses this question by emphasizing the role that citizens play in determining the success of society. Citizens who are actively involved in shaping the political climate they exist in are an important cog in achieving the ideal society. These citizens are in possession of certain character traits, which are called ‘civic virtues’ which enable them to participate effectively. Such citizens are able to discuss matters in a way that values finding the common good for all. They are able to exercise courage to confront office bearers or other citizens who are taking advantage of others. Lastly, they are also able to accept that achieving the ideal society is a long term project and they are able to find contentment along this journey. The study points out how civic virtues are developed as people experience the world and draw lessons from it by reflecting on their experiences. The study further emphasises how sport can be a useful avenue to nurture this type of citizen because of the experiences one goes through in sport. For example sport persons have to deal with losses and also have to learn to achieve goals as part of a team. Such experiences can lead to lessons which can be integrated into their civic virtues. Experiences of the type just described are indirect experiences. Furthermore sport has a more direct role in political life. For one, sport can be used to bring to light unjust conditions prevailing in society, for example, as when athletes make political statements while participating in sport competitions. These direct experiences have lessons which are closely linked to civic virtue. The overall sentiment of this study, then, is that sport is fertile ground to develop civic virtue and that this should be encouraged as much as possible by coaches, sport leaders and athletes as long as it does not harm the actual activity of sport.
