As a tribute to their academic teacher and to further his interests, the students of Prof. Dr. Laurent Waelkens collected fifteen scholarly contributions on 'ius commune graeco-romanum', written by academics from eleven different countries, mainly but not exclusively from Eastern Europe. The book consists of three main parts. In the first part, four authors focus on the Graeco-Roman law in the Roman Empire itself. In the second part, five contributions concern the influence of Graeco-Roman law outside of the Byzantine Empire. The six contributions of the third and final part study the impact of the Western 'ius commune' tradition on Eastern European countries. Thus, the volume highlights the continued importance of the study of Roman law for the understanding of our common pan-European legal heritage.

De befaamde Duitse rechtshistoricus, Theodor Mommsen, beschouwde in zijn Römische Geschichte de eilanden Sicilië, Sardinië en Corsica als de natuurlijke aanhangsels van Italië. Vandaag behoren Sicilië en Sardinië nog steeds tot het Italische schiereiland, maar Corsica niet (meer) en het lijkt onwaarschijnlijk dat het ooit nog onder de soevereiniteit van Italië zal vallen.Blijkbaar is de eeuwenlange rode draad die het eiland Corsica met het Italiaanse vasteland verbond ergens onderweg geknapt. Het doorknippen van de band met de Europese rechtstraditie is in onze ogen tegelijk realiteit en mythe. De breuk lijkt in die mate onherstelbaar dat een aansluiting met de Franse of gelijk welke andere rechtscultuur onvoorstelbaar is. Toch is het onze betrachting om met deze masterproef het ontstaan en de ontwikkeling van Corsica als politiek-juridische entiteit in te bedden in de klassieke schema's van de continentale rechtsgeschiedenis.Eerst zetten we de toon met een essayistische schets van de relevantie van de soevereiniteitskwestie als Romeinse erfenis in de westerse rechtstraditie (hoofdstuk 1). Vervolgens plaatsen we Corsica zowel in de instellingen en structuren van de Antieke Oudheid (hoofdstuk 2) en de Vroege middeleeuwen (hoofdstuk 3).Geleidelijk aan wordt duidelijk hoe de analyse van de soevereiniteitskwestie op Corsica in het eerste millennium van onze jaartelling draait om het ontrafelen van diverse claims op een... soevereiniteitsclaim. Soevereine rechtspraak is de iure een spreekbuis in concrete conflicten van een abstracte en gelaagde normenhiërarchie. De facto is het echter vaak een dwangbuis voor het opleggen van normen of het onderwerpen aan normen. Tussen het nominale en het reële gezag van de soeverein(e rechter), speelt zich de rechtsgeschiedenis van Corsica af.
