Abstract

Abstract Why did the subject of law play a central role in sociology as it emerged? And why is this no longer the case today? This study explains this transformation of the sociological interest in law by means of a genealogical investigation into the mutual references between the jurisprudence of private law and sociology: the way in which, from a legal perspective starting in the 19th century, law has been addressed as a social phenomenon in the face of concrete problems is reflected in the early sociologies of Émile Durkheim, Ferdinand Tönnies and Max Weber. This has led to a mutual demarcation, which places law and sociology in a problematic relationship to each other for the future.

Abstract

An introduction to Canadian legal history featuring new approaches to legal scholarship. Essential reading for all those interested in Canadian legal methodologies, especially new and beginning scholars. Canada’s Legal Pasts presents new essays on a range of topics and episodes in Canadian legal history, provides an introduction to legal methodologies, shows researchers new to the field how to locate and use a variety of sources, and includes a combined bibliography arranged to demonstrate best practices in gathering and listing primary sources. It is an essential welcome for scholars who wish to learn about Canada’s legal pasts—and why we study them. Telling new stories—about a fishing vessel that became the subject of an extraordinarily long diplomatic dispute, young Northwest Mounted Police constables subject to an odd mixture of police discipline and criminal procedure, and more—this book presents the vibrant evolution of Canada’s legal tradition. Explorations of primary sources, including provincial archival records that suggest how Quebec courts have been used in interfamilial conflict, newspaper records that disclose the details of bigamy cases, and penitentiary records that reveal the details of the lives and legal entanglements of Canada’s most marginalized people, show the many different ways of researching and understanding legal history. This is Canadian legal history as you’ve never seen it before. Canada’s Legal Pasts dives into new topics in Canada’s fascinating history and presents practical approaches to legal scholarship, bringing together established and emerging scholars in collection essential for researchers at all levels.

Abstract

Focusing on everyday legal experiences, from that of magistrates, novelists and political philosophers, to maidservants, pauper men and women, down-at-heel attorneys and middling-sort wives in their coverture, History and the Law reveals how people thought about, used, manipulated and resisted the law between the eighteenth and the twentieth centuries. Supported by clear, engaging examples taken from the historical record, and from the writing of historians including Laurence Sterne, William Godwin, and E. P. Thompson, who each had troubled love affairs with the law, Carolyn Steedman puts the emphasis on English poor laws, copyright law, and laws regarding women. Evocatively written and highly original, History and the Law accounts for historians' strange ambivalent love affair with the law and with legal records that appear to promise access to so many lives in the past.

Abstract

Abstract

This book focuses on the teaching methods and doctrine produced at the Orléans law school between 1230 and 1320. This crucial period in the history of legal science was the heyday of the Orléans studium, whose writings spread throughout the medieval West and whose students joined the careers of high public administration, royal or ecclesiastical. While highlighting the part played by the Orléans jurists in the tremendous renewal of legal teaching methods and legal concepts in the 13th century, this book sheds light on the mechanisms of doctrinal transmission which, from masters to students, forged a genuine scolar identity over time.
