De par leur présence dans la plupart des conflits armés récents ou actuels, les groupes armés non étatiques représentent incontestablement un défi majeur pour le droit international. Partant de ce constat, l'objectif de cet ouvrage est d'offrir une étude approfondie et globale des groupes armés non étatiques en droit international. En application de critères issus du droit international public façonné par l'étatisme, l'ouvrage définit ainsi les notions de groupe armé non étatique et de membre de celui-ci dans un contexte marqué par la multiplicité des entités non étatiques. Sur la base des notions de sources du droit, de responsabilité, de jus in bello, de jus ad bellum et des droits de l'homme, il permet de saisir la nature et l'intensité des rapports entre le droit international public et les groupes armés non étatiques. Il met ainsi en lumière le conflit gouvernant lesdits rapports qui illustre la tension entre l'intérêt humain et l'intérêt étatique.

States invariably justify using force extraterritorially by reference to their right of self-defence. In doing so, they accept that the exercise of this right is conditioned by the customary international law requirements of necessity and proportionality. However, these requirements are notorious for being normatively indeterminate and operationally complex. As a breach of either requirement renders ostensibly defensive action unlawful, increased determinacy regarding their scope and substance is crucial to how international law constrains military force.This book examines the conceptual meaning, content, and practical application of necessity and proportionality as they relate to the right of self-defence following the adoption of the UN Charter in 1945. It provides a coherent and up-to-date description of the applicable contemporary international law and proposes an analytical framework to guide its operation and appraisal. This book argues that necessity and proportionality are conceptually distinct and must be applied in the foregoing order to avoid an insufficient 'catch-all' description of legality or illegality. Necessity determines whether defensive force may be used to respond to an armed attack and where it must be directed. Proportionality governs how much total force is permissible and prohibits excessive responses. Both requirements are shown to apply on an ongoing basis throughout the duration of an armed conflict prompted by self-defence. Compliance with necessity and proportionality ensures that the purposes of self-defence are met, and nothing more, and that defensive force is not unduly disruptive to third party interests and to international peace and security.

This ePaper is a historically informed analysis of the experiences of asylum seekers in Japan. It engages in ethnographic research through the first-hand accounts of 37 asylum seekers, adapted from interviews conducted by Sophia University’s Refugee Voices Japan project. The perceptions, policies, and practices related to asylum seekers are products of the systemic invisibilisation of mobility and migrants’ roles throughout Japanese history, despite their highly politicised presence in mainstream discourses. The ePaper addresses the continued absence of knowledge about asylum seekers by centralising their voices and stories, which opens a window into the complex realities of their experiences of displacement and seeking asylum in Japan. Their narratives demonstrate that the immigration regime severely restricts all aspects of their lives. Yet, asylum seekers are not passive victims ‘stuck in limbo’ but are active members of society employing various strategies in search of solutions for a less precarious life. The Shared Responsibility in International Law series examines the underexplored problem of allocation of responsibilities among multiple states and other actors. The International Law Commission, in its work on state responsibility and the responsibility of international organisations, recognised that attribution of acts to one state or organisation does not exclude possible attribution of the same act to another state or organisation, but has provided limited guidance on allocation or reparation. From the new perspective of shared responsibility, this volume reviews the main principles of the law of international responsibility as laid down in the Articles on State Responsibility and the Articles on Responsibility of International Organizations, such as attribution of conduct, breach, circumstances precluding wrongfulness and reparation. It explores the potential and limitations of current international law in dealing with questions of shared responsibility in areas such as military operations and international environmental law.
