This second volume of Quaderni "Cesare Alfieri" offers a consideration on some basic aspects of our academic system. Among the many topics worthy of attention, the Scientific Committee has decided to put the accent on the theme of the relationship between universities and economic and social development. In response to the transformations and the dramatic downsizing of the higher education system, how is it possible to affirm the centrality of the education of the "human capital", aimed at the growth and cohesion of society? The essays gathered in the volume offer, each one from its own point of view, interesting insights and points of discussion on how, at the present time, universities can contribute to the economic and social development of a country in which territorial and social inequalities are deepening, despite reduced public resources, limited degree of autonomy and uncertain relations with other national and local actors.

Der Autor untersucht analytisches Potential und normative Konsequenzen der völkerrechtlichen Konstitutionalisierungslehre. Anhand der Begriffsgeschichte zeigt er zunächst auf, wie sich der Verfassungsbegriff aussagekräftig auf das Völkerrecht übertragen lässt. Sodann spürt er Vorläufern und philosophischen Wurzeln nach und sucht nach neuen Anknüpfungspunkten für die Konstitutionalisierungsthese. Vor diesem Hintergrund unterzieht er die Hierarchisierung und Objektivierung des Völkerrechts sowie die Bindung von internationalen Organisationen an Menschenrechte als mögliche Verfassungsmerkmale einer kritischen Auseinandersetzung. Der Autor kommt zu dem Ergebnis, dass Konstitutionalisierung vor allem ein Prozess des Identitätswandels und der Selbstverstrickung ist, der Begründungslasten für die juristische Argumentation schafft. Methodisch wird die Genese konstitutioneller Normen als Bildung allgemeiner Rechtsgrundsätze in Auseinandersetzung mit konstruktivistischen Ansätzen in den Internationalen Beziehungen erklärt.

The balancing of rights of equal status is a question widely debated in all modern legal systems, but the complexity of western societies – increasingly engaged with the interaction of different cultures and traditions – expands its quantitative and qualitative significance immeasurably. The purpose of this book is to appraise the potential intersection between two values that are crucial in every community: religious freedom and freedom of intellectual expression. The European Unions legal order is traditionally seen as largely autonomous within the global legal system. At the same time, the EU is an important player in the global governance network and has revealed its dependence on international law and international normative processes. The strong and explicit link between the EU and a large number of other international organisations raises questions concerning the impact of decisions taken by those organisations and of international agreements concluded with those organisations on the autonomy of the EU legal order. While the relationship between international and EU law as such is a popular academic theme, the increasing influence of norms enacted by international organisations and more loosely structured bodies on the shaping of the EU and its legal order has never before been studied in a similar comprehensive fashion.
