Les normes juridiques étatiques cohabitant avec les normes juridiques religieuses, la conjonction de ces deux univers normatifs suggère parfois des solutions à des problèmes juridiques en forme de point d’interrogation. Il en résulte ainsi un décalage pour les croyants. En matière de divorce notamment, la conciliation entre ces ordres normatifs emporte nombre de défis.Cette étude s’attarde à la façon dont ces normes coexistent en plus de porter une attention particulière à l’impact d’une potentielle prise en considération des normes religieuses et à son incidence sur la réalisation des droits fondamentaux des femmes. Elle propose une brève analyse de ces questions se centrant sur des exemples émanant du droit canadien et du droit américain.
