Die Technisierung der Natur und des menschlichen Körpers droht außer Kontrolle zu geraten. Der Ethik muss es um Kriterien der Passung von Technik, Natur und Menschenwürde gehen. Ihre Methode ist eine historisch belehrte Vernunft. In der gegenwärtigen Phase der ökonomisch-technischen Entwicklung werden Natur und Mensch zunehmend zum Material der Perfektionierung. Spontaneität und Mannigfaltigkeit drohen zu verschwinden. Autonome Lebensführung wird technischen Imperativen der Leistungssteigerung unterworfen. In diesem Buch geht es um Kriterien der Richtung und der Begrenzung technischer »Verbesserung«. Sie entstammen begrifflichen und historischen Überlegungen über eine erstrebenswerte (»gute«) Welt und die Rechte des Menschen. Dazu gehört eine Natur des Gedeihens mannigfaltiger Lebensformen und eine Kultur der Anerkennung von Menschenwürde und kultureller Vielfalt.

Do preferential trade agreements (PTAs) lead to greater market integration, more intense competition and less market power for firms? This paper integrates the detailed data on 257 preferential trade agreements from the World Bank's Deep Trade Agreements (DTA) database with administrative customs datasets of product-level exports by firms from thirteen developing and emerging countries to estimate the responsiveness of firm-level exports, export prices, and destination-specific markups to trade and domestic policy commitments enshrined in deep trade agreements. The findings suggest that both the direct and indirect effects of deep trade agreement provisions on export sales are quantitatively significant. Perhaps more interestingly, the finding of a suggestive evidence of a pro-competitive effect of PTAs.

The European border regions perform a specific horizontal integration function. From the perspective of public administration theory, this publication lays the foundations for conceptualising the policy area of cross-border cooperation in Europe as a horizontal level of integration. To this end, the volume analyses the integration theory specifics of its genesis, the functional particularities of its governance with regard to the decentralised integration of different political–administrative, legal and cultural systems, as well as the patterns of emergent, transnational territorial institutionalism. Finally, administrative perspectives on the study of cross-border cooperation as a horizontal level of the European Administrative Area are also presented.

Le droit de libre circulation qui est garanti aux citoyens de l’Union et à certains ressortissants d’Etats tiers serait illusoire sans la reconnaissance des diplômes qui permet son exercice effectif. La reconnaissance à des fins professionnelles est organisée par voie de directives. L’état du droit dérivé connaît une importante évolution à la date du 20 octobre 2007, qui marque l’expiration du délai de transposition de la directive 2005/36 du 7 septembre 2005. Outre qu’elle réalise une simplification et une rationalisation de l’acquis en la matière, elle lui apporte de nouveaux développements. Elle comporte ainsi un volet nouveau, pour la plupart des professions concernées, qui tend à faciliter la prestation de services. Elle prévoit aussi de nouveaux instruments visant à permettre une reconnaissance plus équitable. La reconnaissance à des fins de poursuites d’études ne bénéficie pas des mêmes instruments. Elle relève très largement de mesures de caractère incitatif. Cependant, elle a connu des progrès significatifs dans le cadre du programme Erasmus, tandis que la jurisprudence récente de la Cour de justice entraîne de nouvelles avancées. Dans le cadre communautaire, elle constitue l’un des éléments d’un statut de l’étudiant en mobilité, qui repose sur l’attribution du droit de séjour et l’égalité de traitement. Plus largement, le processus de Bologne apporte une contribution qu’il convient d’évaluer. Cet ouvrage analyse tous ces développements et dresse un état complet des réalisations dans cet important volet de l’action communautaire. Il comporte le texte de la directive 2005/36 et de la directive 98/5 relative à la libre circulation des avocats. Auteur de nombreuses études sur la reconnaissance des diplômes, l’éducation ou la citoyenneté de l’Union, Jacques Pertek a mené une double activité d’administrateur, notamment comme premier directeur de l’agence Erasmus en France, et d’universitaire, en France et aux Pays-Bas. Il est l’auteur de plusieurs ouvrages, dont les plus récents sont le Droit des institutions de l’Union européenne et le Droit matériel de l’Union européenne. Il a été le rapporteur du Groupe d’experts indépendants chargé par la Commission d’une étude sur la reconnaissance des diplômes à des fins académiques et à des fins professionnelles. Il a coordonné la réalisation d’une étude confiée par le Parlement européen à la Fondation pour les Etudes Européennes, qu’il préside, dans le cours de l’élaboration de la directive 2005/36.
