Abstract

Human use of marine resources is changing, as is the marine environment itself, and our understanding of marine ecosystems and biodiversity is developing. This open access book explores the challenges this raises for legal regimes pertaining to the oceans and their domestic implementation. It engages with developments in areas such as bioprospecting, fisheries, deep-sea mining and shipping. Several case studies discuss genetic resources and the implications of the new UN Agreement on marine biological diversity of areas beyond national jurisdiction. A team of experts suggest new approaches to questions of interpretation, established management principles, and institutional relationships. Not limiting their scope to the international law of the sea, they also examine international environmental law, intellectual property rights, and domestic law. The book broadens the scholarly debate and provides a timely reflection on the dramatic policy developments currently happening in the field of marine resource governance. It will be welcomed by lawyers, NGOs and policymakers. The ebook editions of this book are available open access under a CC BY-NC-ND 4.0 licence on bloomsburycollections.com. Abstract

This book addresses the rights of indigenous peoples to marine space and associated marine resources under international law. Examining the rights of indigenous peoples relating to marine space and marine resources both in international human rights law and the law of the sea, the book provides an in-depth critical analysis of the existing legal framework, whilst identifying the gaps, and possible further mechanisms, for recognizing the rights of indigenous peoples to marine space. The book addresses three main issues: 1) the extent to which international law recognizes and protects the rights of indigenous peoples in relation to marine space and marine resources; 2) if and how the law of the sea and international human rights law pertaining to the rights of indigenous peoples to marine space and marine resources interact; 3) whether and to what extent the law of the sea regime limits the capacity of coastal States to recognize and implement the rights of indigenous peoples relating to marine space and resources. In response, and in a context where indigenous marine rights are under increasing threat, the book develops an important critical theoretical and methodological approach which moves beyond the current doctrinal focus of much existing work in this area. The book will appeal to academics, researchers, and practitioners in the areas of indigenous peoples and the law, international law, the law of the sea, and human rights.

Abstract

Artificial Intelligence and Edge Computing for Sustainable Ocean Health explores the transformative role of AI and edge computing in preserving and enhancing ocean health. The growing influence of Artificial Intelligence (AI), along with the Internet of Things (IoT) in generating wide coverage of sensor networks, and Edge Computing (EC) has paved the way for investigation of underwater as well as massive marine data, thereby generating huge potential for credible research opportunities for these domains. This book’s journey begins with a broad overview of Artificial Intelligence for Sustainable Ocean Health, setting the foundation for understanding AI's potential in marine conservation. The subsequent chapter, Role of Artificial Intelligence and Technologies in Improving Ocean Health in Promoting Tourism, illustrates the synergy between technological advancements and sustainable tourism practices, demonstrating how AI can enhance the attractiveness and preservation of marine destinations. Further, Revolutionizing Internet of Underwater Things with Federated Learning, Underwater Drone, Underwater Imagery with AI/ML and IoT in ROV Technology and Ocean Cleanup has been demonstrated using innovative approaches to addressing underwater challenges. The book also includes a Review on the Optics and Photonics in Environmental Sustainability, focusing on the role of optics in marine conservation.
