Since the migration movements from Islamic countries, a Muslim diaspora has developed in many Western societies. While in classical Islamic theology residence in non-Muslim countries has always been a controversial issue, in the course of globalization and internationalization processes the classical distinction between "Islamic world" and "non-Islamic world" has been put into perspective. Now nearly 30 million Muslims live in Europe. The book offers an overview over Muslim communities in Europe, their history, present issues, and future challenges. The Editors: Rauf Ceylan is Professor for Contemporary Studies of Islam at the Institute for Islamic Theology, Osnabrück University. Marvin Mücke is research assistant at the Institute for Islamic Theology, Osnabrück University. .

"The volume compares the efforts to instil the values and practices of the rule of law in the Middle East in the early twenty-first century with their disappointing performances in terms of safety, human rights, and, especially, religious freedom. It zooms in on Afghanistan, Egypt, and Iraq to argue that international interventions and local initiatives underestimated the ethno-religious mosaic of these countries and their political and constitutional culture. The standard notion of the rule of law values individualism, equality, rights, and courts, which hardly fit the makeup of the Middle East. Securing stability and protecting religious freedom in the region requires compromising on the rule of law; the consociational model of constitutionalism would have better chances of achieving them"--

"This book would assemble a number of essays from the past several years that address the question of whether human rights remain valid as universal standards for action in a multicultural, religiously pluralistic and economically unequal world. It draws on the Roman Catholic tradition to help answer this question in a positive way, and also suggests ways that today's global realities call for important developments in the Catholic tradition. It applies the proposed understanding of human rights to several issues that are much debated today, including religious freedom, the rights of refugees and other forced migrants, economic rights in the face of significant inequality, and the rights of women. It will be of use to those in the Catholic community who are working to advance human rights, to those interested in why the Catholic church is engaged in human rights issues, and to all who seek to advance human dignity on humanistic grounds. It addresses both those considering human rights in academic settings and practitioners working to advance human rights in the field"--

For centuries, since the Roman Empire's adoption of Christianity, the continent of Europe has been perceived as something of a Christian fortress. Today, the increase in the number of Muslims living in Europe and the prominence of Islamic belief pose questions not only for Europe's religious traditions but also for its constitutional make up. This book examines these challenges within the legal and political framework of Europe. The volume's contributors range from academics at leading universities to former judges and politicians. Its 19 chapters focus on constitutional challenges, human rights with a focus on religious freedom, and securitisation and Islamophobia, while adopting supranational and comparative approaches. This book will appeal not merely to academics and law students in the UK and the EU, but to anyone involved in diplomacy and international relations, including political scientists, lobbyists and members of NGOs. It explores these contested relationships to open up new spaces in how we think about religious freedom and co-existence in Europe and the crucial role that Islam has had, and continues to have, in its development.

"The right to freedom of thought, conscience and religion in Article 9 of the European Convention on Human Rights (ECHR) has become increasingly significant and contested. Through an examination of ECHR Article 9, its drafting history, and the related jurisprudence of the European Court of Human Rights (ECtHR), Caroline K. Roberts challenges the classic approach to this right in the literature. Roberts argues that claims that there is, or should be, a clear binary and hierarchical distinction between the absolutely protected internal realm and the qualified external realm in this right are not founded textually or jurisprudentially. Rather, the primary materials suggest that the internal and external aspects are deeply interrelated, and this is reflected in the ECtHR's nuanced and holistic approach to ECHR Article 9 protection"--

"Derived from the renowned multi-volume International Encyclopaedia of Laws, this convenient resource provides systematic information on how the United States deals with the role religion plays or can play in society, the legal status of religious communities and institutions, and the legal interaction among religion, culture, education, and media. After a general introduction describing the social and historical background, the book goes on to explain the legal framework in which religion is approached. Coverage proceeds from the principle of religious freedom through the rights and contractual obligations of religious communities; international, transnational, and regional law effects; and the legal parameters affecting the influence of religion in politics and public life. Also covered are legal positions on religion in such specific fields as church financing, labour and employment, and matrimonial and family law. A clear and comprehensive overview of relevant legislation and legal doctrine make the book an invaluable reference source and very useful guide. Succinct and practical, this book will prove to be of great value to practitioners in the myriad instances where a law-related religious interest arises in the United States. Academics and researchers will appreciate its value as a thorough but concise treatment of the legal aspects of diversity and multiculturalism in which religion plays such an important part."--
