Inspired by the vision of the future of humankind in outer space, an international team of technical experts, lawyers and political scientists examined topical issues of law and policy under the leadership of the editors - not only with respect to international space flight and space exploration, but also in view of the safe and sustainable use of space technology for the benefit of our planet. After all, our original habitat should not be sacrificed on our way to Moon and Mars ! In this regard, this book examines fundamental questions like the problem of space debris, the safe use of nuclear power sources in outer space, the protection of the ozone layer during space launches, the issue of light pollution and the protection of the marine environment during the guided re-entry of space craft into the High Seas. In addition to these problems of technical nature, questions relating to the peaceful, equitable and responsible use of outer space are explored also with regard to issues as space traffic management which must be solved by scientists, lawyers and politicians on an international scale, and supported by an again increasingly interested general public.

En réalité, le sujet retenu a réuni tous les ingrédients qui sont le gage d'un colloque réussi : - il a permis de faire le point sur un sujet d'une brûlante actualité et en évolution rapide ; - il a été un lieu de débats et de confrontation des points de vue entre des internationalistes (et des internistes) de droit public et privé, et il a été enrichi par la participation de techniciens et de praticiens ; - les deux beaux rapports introductifs, très complémentaires, les nombreuses et riches communications et les réflexions conclusives permettent au non-spécialiste de se « remettre à niveau », tout en ouvrant des perspectives doctrinales extrêmement enrichissantes. Pas seulement doctrinales d'ailleurs. A la lecture de l'ouvrage, on a parfois le sentiment de lire un ouvrage de science-fiction et l'on est pris de vertige face à « l'espace affreux et captivant » (BAUDELAIRE) qui renvoie inévitablement au silence éternel qui effrayait Blaise PASCAL. Mais clairement, la réalité rejoint la fiction et interpelle le juriste au point que l'on a pu se demander si la gouvernance future de l'espace n'échapperait pas au droit au profit de la seule technologie ; cauchemar d'un monde régenté par l'intelligence artificielle...

This book explores how Europe is seeking to enlarge its launching capacities by building additional spaceports on the European continent. Various national initiatives are envisaged resulting in a "space race" in the field of constructing spaceports and building micro launchers. However, right from the beginning when choosing the launch site (land or sea based-rocket launches) there are various factors relating to international space law, European regulations and national rules that must be considered, as spaceports are rarely explicitly addressed in current legal and policy frameworks. While launching sites used to be operated by governments, private commercial initiatives are increasingly entering the field. This paradigm shift must be reflected within regulations relating to various aspects of space liability by enlarging the long-established terms of the United Nations space treaties to accommodate commercial space flights. Questions of permission, supervision and control require special liability regulations to avoid detrimental consequences stemming from the concept of "launching states" in view of the rise of private driven commercial space activities on a global level. Furthermore, not only do environmental aspects need to be thoroughly examined but also the concept of critical infrastructure requires special attention from a security perspective to anticipate, inter alia, cyber-attacks. For these reasons, several European and national regulations may need to be enlarged to apply to the entire space sector, using a harmonized approach that has direct implications for the regulations, programmes, and missions of the European Union and the European Space Agency, bearing in mind that the upcoming spaceports in Europe are an essential asset to substantially boost the European New Space.
